Hi my name is jayanth.Can anyone please explain about terminating an employee. I recently got terminated from my job without any prior notice or warning letter. My mistake was i went to office in a drunk state but i drank only a beer. I dont think that its such a big on that any one can get terminated.

Hi Jayanth,
Be it beer or wine, all these fall under the category "Alcohol". If an employee has found under the influence of Alcohol during the business hours, it is purely considered as "Breach of Code of Conduct" and would lead to termination of employment.

Sir, I have been working in that company from last 3 years, now if the HR has terminted me.In my lifetime I am not eligible to attend any of the interviews conducted in that company moreelse is it possible to provide these pay slips to another organization in which I would be selected. I tried my level best to convince my Hr, however he issued a termination letter. I requested him not to issue a termination letter apart from that please give me relieving letter so that i can apply for any other company. But he is not listening to any of my words. Is there any chances for me to be selected in an interview as experienced employee or i have to again startup my career as a fresher. Please reply soon. Waiting for your advise.

Sir I do understand that this type of misbehaviour is aginst the company norms but an employee should be atleast get issued by a warning letter by considering his experience in that particular company. Suppose if a person is being caught by a policemen then they warn the accuse,or ask him to pay penalty charges in court but they will not directly shoot him. Every where in india there are sign board stating don't drink and drive but we do not care and performs our regular activity. If once we get warned or there might be a situation where we have to be behind bars for these type of activities no one will ever repeat it. Sir ek galti toh maaf hoti hai na.

Why i am explaining this is, an HR or a policemen dont have rights to spoil any one's future just to achieve medals or honour. He might be praised by his collegues that he has done a wonderful job by terminating the employee but as a human being has any HR thought about an employee. If I issue him a termination letter does he eligible to attend any other interview. Sir everyone in this world is working to fulfill his dreams , take care of their family and too for hunger. This 8s my life sir.

Hi Jayanth,
I completely honour your current state of mind. There are few misconducts which cannot be stopped with a warning letter. For example, sexual harassment, usage of weapons, alcohol/narcotics, etc are treated as prime violation in the corporate world. You have mentioned in your statement that you went to office in "drunk state" and not "after drinking beer".
Keeping these apart, all you can do now is to plead to the HR department to revoke the termination letter issued to you. With a termination letter, it would be hard for other companies to consider your employment application. Good luck!

For a disciplinary action, there is no need of looking at your service. You have gone to the establishment under the influence of alcohol, which is a grave misconduct.
However, when they have terminated you , before that they establish the fact that you are under the influence of alcohol and the disciplinary issue should under went domestic enquiry and when it is proved you may be terminated.
But in your case it is not done, hence you may fight. However, going in drunken condition to establishment is grave misconduct, why not you stop on your own rather they terminate you.
