In a family one person is having an ESI card which included all family members. One of a member has joined in another company and want to avail the facility. Is it possible to avail him/her an another account (another smart card). If not how the new company will accommodate his/her ESI claim. Kindly suggest.

There is no restriction on different members of the family from owning all holding different and independent identity cards from ES I C.
Which of the cards the person wants to use when he is sick is his choice. Whether he takes a card or not, the company will be required to deduct the ESIC contribution and pay the same to the government.
Logically, when the employee is sick he will use his card and not his family card

1. Sir, there are only 2 type of ESI cards-one is Identity Card meant for Insured Person/employee and second is Family Identity Card, which is meant for the family members of an insured person/employee. The detailed procedure has been mentioned in Regulations 17 & 95A of ESI (General) Regulations, 1950. ESIC also issues combined card which include the names of family members also. This is procedural matter.

2. If an Insured Person/employee changes his employment, he is required to get his identity card corrected by concerned Branch Office of ESIC. I think, there is some form for this purpose also which can be obtained from concerned Branch Office. Online facilities to change the code number may also be available, which can be ascertained from concerned Branch Office. If the said insured person will not get his Identity Card/family identity card corrected by entering the code number of new employer in his cards, then he will face problem of getting medical benefit because after close of benefit period, he/his family will not be entitled for any benefit (though the said insured person/employee may still be contributing under ESI Act, 1948 and rules/regulations framed thereunder).

3. When an insured person/employee leaves a factory/organisation and joins new unit, covered under said Act, he must disclose his old insurance number and old code number of previous employer to the concerned officials of his unit, otherwise as mentioned above, he may face disentitlement even for medical facilities after the close of relevant benefit period.

I think he is talking of a family with 2 persons working for 2 different companies, both covered under ESIC. So,do,they get 2 I'd cards and 2 family cards ? And whether that would be a violation of law

1.Sir, I am not sure whether it will be a violation of law of keeping 2 different Identity Cards for the same employee ?. We have to go through the procedure as laid down in Rules & Regulations. But I think, by claiming any benefit on previous Identity Card, the said insured person will definitely be at loss as explained by me in my remarks as above. Since now the records are online, the concerned dispensary will declare the said person presenting old IC as 'NOT ELIGIBLE" and similar treatment he will get from Branch Office of ESIC.
2. When 2 separate Identity Cards have been issued for 2 covered employees of a family, naturally their entitlement will be as defined under said Act and rules and regulations.

Yes Sir, My doubt is what exactly raised by Mr. Harsh, and the same point has raised by the employee who has joined in a new company.
