Dear Seniors, One of our employee is availing maternity leave who is not under coverage of ESI. Please tell me whether the company has to pay medical bonus to employee if yes how much?

Dear Aman,
If your unit is covered under the Maternity Benefit Act, 1961 then you are also to pay medical bonus of Rs. 3500/- along with 2nd installment. This medical bonus is payable if pre-natal confinement & post -natal care is not provided by the employer free of charge( sec. 8).

If the employee come under the ESI act ? How much Medical bonus will be paid under the maternity benefits ?

Dear In our opinion Medical Bonus is not being paid to the insured employees under ESI Act, 1948 & the Rules made thereunder. R N KHOLA

Dear Member,
You have to go through applicable Maternity Benefit Rules to see when this medical bonus is to be paid. In case of Haryana, we are to pay medical bonus with second installment of the maternity benefit in accordance with Rule 6(4) of Haryana Maternity Benefit Rules, 1967.

Payment of medical bonus. -- Every woman entitled to maternity benefit under this Act shall also be entitled to receive from her employer a medical bonus of (earlier it was Rs.25 gradually increased from time to time), if no pre-natal confinement and post-natal care is provided for by the employer free of charge. A pregnant women worker is entitled to a maternity benefit (in the form of medical bonus) of Rs.1,000/= if no prenatal confinement and post-natal care is provided by the employer free of charge. It can be increased to a maximum limit of twenty thousand rupees. The Central Government is authorized to increase the basic amount every three years. In August 2008, the amount of medical bonus was Rs.2500 which has been later raised in 2011 to Rs.3500/-As per the MB Act, 1961 & the Rules made thereunder the employer has to pay medical bonus along with 2nd installment. This amount is to be paid within 48 hours of production of proof that the woman has been delivered a child. )Pl.see Sec.8 of Maternity Benefit Act.) The following are other entitlements:
CASH BENEFIT:
1.Leave with average pay for six weeks before the delivery
2.Leave with average pay for six weeks after the delivery
3. A medical bonus of Rs. 3500 if the employer does not provide free medical care to the woman
4.An additional leave with up to one month if woman shows proof of illness due to pregnancy, delivery, miscarriage or premature birth
5.In case of miscarriage, six weeks leave with average pay from the date of miscarriage
NON CASH BENEFIT
1.Light work for ten weeks (six weeks plus one month) before the date of her expected delivery, if she asks for it
2.Two nursing breaks in course of her daily work until the child is 15 months old
3.No discharge or dismissal while she is on maternity leave
4.No change to her disadvantage in any of the conditions of her employment while no maternity leave
5.Pregnant woman discharged or dismissed may still claim maternity benefit from the employer
- EXCEPTION: Woman dismissed for gross misconduct lose their right under this Act
