Looking for your precious advise on the below matter.
I was working in a company where it is mandatory to provide notice period of 03 months or the salary in lieu of the same. I have not served even a single day notice as i was getting a very good offer and that other company was not willing to give me anytime. Now the company is asking me to give them the 03 months gross salary. But on the appointment letter its the "salary" word which is mentioned but nothing else whether Gross or Basic - So what i am liable to pay them as per the law? Please advise.

Unless otherwise specified in the Standing Orders of the company or in the appointment order issued to you, salary means gross salary which is agreed to as payable if you had worked for a full month. You can exclude the reimbursements and annual components from it. There are different interpretations to salary and with regard to notice pay it shall only include only Basic salary and dearness allowance. But the salary as per terms of appointment is what salary means for all the purposes because it is the salary agreed by the company and the one you have accepted on joining. therefore, pay it and solve the issue.
