Hi, Can someone help me with the National and Festival Holidays Act. I am looking for what is the minimum and maximum number of National and festival holidays we need to give in a year. Thanks in Advance.

Dear Richa,
There is no holiday list specified by govt. You have to give minimum holidays as per your company rules. But your holiday list must include national holidays which are compulsory. National Holidays are. 15th August - our independence day, 26th Jan - Our republic day, 2nd October - Gandhi Jayanti and 1st may - labour day and maharstra day.
There is no holiday Act but weekly act is available .

Thank you. I remember reading somewhere that establishments in Maharashtra excluding mumbai are entitled to 10 days public holidays including the 4 mandatory national holidays. Mumbai is entitled to 10 days plus 2 additional days as optional holidays.

As far as my knowlegde goes like other mentioned leaves are entirely dependent on what the company wants to give . However the compulsory ones are Independence Day , Republic Day and Gandhi Jayanthi. Labour or May day is an optional one.
Normally the range is anywhere b/w 8 to 14 days of Festival,State and Government Holidays ( depending on the state there can be one compulsory holiday Ex Karnataka Rajyotsava , Maharastra Day)

The minimum holidays total 07 no. for (including 03 no. National) & 04 other Festival holidays prescribed under the Industrial Employment (standing orders) act 1946 U/S 10 of Central Rules,
the minimum no. of holidays vary state by state pl. see your's state rules under the Act.

There are state legislations for industrial establishments under National and Festival Holidays, but Govt. of Gujarat does not have such enactment. States like Karnataka, Punjab, Tamilnadu have their rules under this enactment. So, there is a debate in which some consultant categorically says that if the the factories registered in Gujarat under Factories Act 1948 do not opt to give National holidays ( 26th Jan, 15 Aug & 2nd Oct), they can do so. In other words, for manufacturing factories in Gujarat it is not compulsory to declare National Holidays to their workers as paid holidays.
This is very crucial question. Opnions and views of learned friends are cordially invited.
