Hie.. I wrk in noida ..in an Indian company.. I come under Esi..my joining date is 16th nov 15. Now I am 8th month pregnancy.. seekng for maternity leave next month.. expected date is 5sep..I want to know wat benefits I am elegible for maternity leave pay from Esi ,?? Will I be paid fully ?and also wats the procedures ? My ofc HR has no knowledge fr this.. they just say Esi will pay fr maternity leave. Pls guide me the procedures to claim maternity leave benefit pay.. also I will undergo delivrry from private hospital not frm esi hospital.. I just want to claim for maternity leave pay

1. Dear member, I think, you must go through the literature on various benefits including maternity benefit so that you may be able to know about the benefits available to you. You can download the same from the website of ESIC. However, I am indicating herewith online link of the said literature as follows:

2. Further, there are certain contributory conditions on the basis of which an insured woman can claim the said maternity benefit. It will be more better, if you visit your appropriate Branch Office of ESIC and obtain forms/guidance on the basis of which you can obtain maternity benefit.

3. As per procedure, you are also to report your self to the Doctor (Insurance Medical Officer) of the ESIC dispensary to which you are attached. The name of dispensary must have been indicated in your Identity Card. Necessary Certification is required to be obtained from said ESI Dispensary or ESI Hospital and submitted to the Branch Office of ESIC. On the basis of said certificates, the concerned Branch Office of ESIC will make you payment of maternity benefit based on your eligibility and entitlement. So, it will be more better, in my opinion, if you may contact above offices. You can enquire / confirm from the Branch Office Manager or ESI dispensary, if you want delivery through admission in a private hospital. You can enquire whether they will allow admission in such private hospital, and if so, what procedure is to be followed ? With best wishes.

Maternity Benefit is payable to an Insured Woman in the following cases subject to contributory conditions:-
Confinement-payable for a period of 12 weeks (84 days) on production of Form 21 and 23.
Miscarriage or Medical Termination of Pregnancy (MTP)-payable for 6 weeks (42 days) from the date following miscarriage-on the basis of Form 20 and 23.
Sickness arising out of Pregnancy, Confinement, Premature birth-payable for a period not exceeding one month-on the basis of Forms 8, 10 and 9.
In the event of the death of the Insured Woman during confinement leaving behind a child, Maternity Benefit is payable to her nominee on production of Form 24 (B).
Maternity benefit rate is 100% of average daily wages.

As per your queries, I think the below may give clear info:

An women employee who has a payment of contribution for 70 days in one or two consecutive periods (i.e either from April-Sept or Oct-Mar contribution period) is eligible for ESI maternity benefit.

Only the Insured women(IW) is entitled to receive maternity benefit for confinement for a period of 12 weeks (of which not more than 6 weeks can precede the expected date of confinement) for all the days on which she does not work for remuneration.

No payment will be made for the days on which she worked for remuneration. But the said days will be counted for the purpose of arriving at the total range of 12 weeks / 84 days.

An insured woman and an insured person in respect of his wife shall be paid a sum of rupees one thousand per case as "confinement expenses" (earlier termed as medical bonus) , provided that the confinement occurs at a place where necessary medical facilities under the ESI Scheme are not available. i.e. where facility for confinement is not available in the ESI institutions at place of confinement. Also confinement expenses shall be payable for two confinements only.

my wife is eligible for ESI maternity benefits, before her delivery, few times she visited dispensary to apply for leave, some attendants/ doctors said that she has to apply leave after delivery and she may not come for this to esi hospital/dispensary, husband can complete the process by submitting discharge summary and birth certificate,
- she delivered at a private hospital, which is very far (350 km) from esi dispensary, now personnel/doctor at dispensary are asking me to bring my wife and child to dispensary, as doctor need to get signature from my wife and also need to confirm gender of baby, to issue some document required to claim maternity,
- is this really mandatory for this scheme?
- how is this possible my wife and baby are weak and cannot come to dispensary?
