If you feel you are weak against them, you can take someone with you to their office to negotiate on the same.
You can ask them to hold the service certificate for not serving the notice period. But holding the original certificates will be considered as illegal. So as per my previous reply, you can proceed further.
We in this forum can guide you till some point. You have take some physical support from your family or your friends to get this work done.
We cannot understand fully about the issues you are facing. You have posted the same question few days back in this forum. Write down all the replies from the experts and make a plan and proceed.
But You can sue them if they don't return your certificates in legal way or through social media.

yes you are right.again & again I'm asking the same questions .it is just bcz I m very much stressed & worried bcz of that management staffs attitude.i am trying for mutual consent but they are not ready to listen.anyway u r right , I have to get moral support from my family.let u all know after i receive my original certificate.

Dear Madhumati,
Before going to Police or Labour department please ensure you have the acknowledgement with you wthich was given by your company at the time of handing over your degree certificates to them.
As you stated lastly, if your health prmits and you are happy with your job you can join them back. if not you can always walk out with a smile politely taking back your certificates.

Dear Msyma,
Thank u for yr reply.i am not willing to join there again.the reasons are,
1.they gave increment to the staffs before 3 years(some of management staffs only got increment)
2.there is no HR (One who acts like a HR is not ready to help staffs in any manner)
3.last 2 years they have appointed so many peoples but all of them resigned due to their bad administration
4.every month we have to please our superiors for getting our salary which is worst part.
....etc(lots more can't discuss here)
if i join there again, it would be a worst nightmare of my entire life.

Dear seniors,
finally i met the management staffs & talk with them.after a long discussion they ask me to produce NOC.after 1 week i have to complete that process. (HR person will come after one week only)
i don't know what will happen after producing NOC.still i dont have any hope about getting my certificates back.
let us wait......

Please take a tough stand.
go to their office and request for handing over your educational certificates.
If they do not file a police complaint and complaint in labour department.
Hesitation is understood-no one wants police complaints etc,but is the company returning your documents.
You have been left with no choice.
Do not hesitate and be firm (but polite) in your words and subsequent actions.

Dear seniors,
finally i got my certificate.thank u all for your support & guidance.
at first i requested them to return my certificates they ask me to pay Rs.50000/- for bond.
i refused to pay that amount.(i m not having that much right now)finally i said i 'm going to send a legal notice through my lawyer then only they accept for some negotiation.but finally i paid Rs.5000 then only they released my certificates.

I am sure you have learnt valuable lessons from this episode.
Every problem which you face gives a chance for learning,upgrading knowledge and understanding employer psychology also.
I am happy you got your degrees back.Next time decline to give the original certificates for safe keeping etc.
Yes for verification and checking for few days it is ok.Always take a receipt from HR person with name and rubber stamp of designation with date.

Why are people still handing over original certificates? This has been discussed many, many times here on CiteHR.
People have said it is illegal. Why are people not taking a stand on this matter.
Get a colour photocopy of your certificate, get it certified as a true copy by a notary or the Indian equivalent, and hand that over.
I know this is complicated, but it is wrong, and needs to be called out. Basically, if the employer takes your certificate, then that is simply THEFT, and you should take legal action. If enough people do it, the practice will eventually stop.
As for employers demanding this, ask yourself, do you really want to work for a thief? If he steals that from you, what else will he steal from you in the future, ie your salary, entitlements etc etc.
People need to start thinking seriously about this matter NOW.
