I come to you with my, sadness, sorrow & pain, only you know, because you’re the only one I can share this with. I heard somewhere that sharing sorrow may heal your pain.

I am writing to tell you about a story of a well know Kolkata based Limited company and its sister concern company. I am working in a ltd company as HR from more than two years. (Starting of this organization). During two years their business expands from West Bengal to Assam, Bihar, Jharkhand, Uttar Pradesh and Uttrakhand. Everything was going fine. Management was thinking for its own plant in Bihar.

In October 2015 suddenly management of this organization decided to close its operation from Bihar, Jharkhand & West Bengal without given any notice. Although they did not give salary for that month. Also LTA, Bonus, TA were not given to employees. Director told them, we have 3 Cr. Outstanding with dealers and Sales persons are unable to collect it from them so we are unable to continue in this situation. Hence management has decided to close our operations in these states. Although at that time we have 800 MT sale from only Bihar & Jharkhand. Starting Sale was 1200 MT from these states which was good. Management decided to bounce dealers security check and lodge case against dealers. At the same time a message was conveyed by HR to all employees that we are going to reopen our own plant in March 2016 & we will prefer our old employees first for the job till date you can join in other company. When they asked for their salary they said we will give it to you when we receive it from dealers. Still they are waiting for their money.

After few months there was a major accident at plant premises in Uttar Pradesh. While sleeping, two employees were found dead in the guest house. (Plant In charge & Supervisor) Due to cold they kept brazier in the room for heat. Company’s director and Management had managed the local police station and whole matter was hushed up. Bribe given to police. No Insurance covered, neither ESIC nor EPF. Although amount was deduction from their salary. Company did not give a single penny to the deceased family. They died due to their carelessness. Every time when we asked for account number they told we will provide you. Personally i wrote many letters for it but did not get any satisfactory reply. (PF & ESIC looked after by Cement HR)

Time passes away, this year in March 2016 again they started the same language; financial condition of the company is not good might be delayed in salary. But we will pay when we receive money. At the end of month we got information from Director & Finance head we are going to close our operation from rest of the states. Employees are free to search new job. One more thing conveyed to HR to retain few plant and sales personnel for our new company. The plan was to open new company with different name within few months. Company will pay for retained employee and clear all due salary of 2 months. But nothing happened; neither have they given salary of last 2 months nor bonus, LTA and PF account number. Lots of mails reminders given to MD, Director and Finance Head but they are not even bother to reply. Not picking phone calls. Now we lost our money along with job. We also approach to civil court and labour court they said search for new job, you will get nothing from here the process is very slow it will take 5 years.

Need your help what should i do..........

My apologies, but why did you continue with a firm knowing what they do to their employees ? Wasn't the first incident was enough for others to decide? I understand lack of employment, but working for such an employer is beyond every risk!
Civil court will take time. More importantly will need a lot of resource to fight against an employer with such deep pockets.
Would suggest you to find a new job rather than focussing on this long drawn fight. I request our seniors and experts on legal to share light on what should be the best way out.

Look around for other jobs first.
Join hands with affected workers and file case of cheating against higher management officials.
Collect individual contributions to fund the case.(it will take time as well as resources)
Write to the Registrar of Companies about the company-actitivites,and other irregularities.
Similarly write to ESIC and PF authorities about non deposit of collected amounts.
Best is hire an advocate who is well versed in labour law and company cases.
If some of you have the will to fight against obvious injustice,then go ahead.
Publicise your case and full details after taking full and proper advice from a good lawyer.
