Dear All,
Our company has registered office in Kolkata but works mainly in Tripura. So I wanted to know Is ESI applicable in entire Tripura or just in few parts of Tripura and from when its applicable. Can you please help me out regarding regions where its not applicable in Tripura.
Further in case its only applicable in Agartala then if a person having residence in Agartala is working at my project in Kamalpur (another place in Tripura) then whether ESI will be applicable for him.

1. Sir, the coverage of an employee under ESI Act, 1948 is based on place where the unit/establishment/factory is located. In case the said area has been implemented under section 1(3) of Act, only then the units situated in said area will be coverable. There is no question of residence of the employee.
2. Confirmation as to which of the areas in Tripura are presently declared as implemented areas is difficult since ESIC had recently announced, that it is going to implement the said Act in some more North-Eastern States. What is the actual position of implementation or extension of scheme in Tripura may be better known either in the Regional Office of ESIC situated at Kolkata (West Bengal) or Regional Office, Assam, Guwahati. Therefore, you may confirm the position from concerned Officers in these regions. Their e-mails/contact numbers can be found on the website of ESIC, Hqrs. Office, website.

Once your company is covered under the ESI Act, it will be applicable to your employee working unless in an exempted area. The residence of the employees is not vital in relation to the coverage of the ESI Act.
