Dear Seniors, does a company need to do full and final settlement in case of termination of services for misconduct? or it goes as per the appointment terms and conditions? pls share your views.

FNF needs to be done even if termination is due to misconduct. It will be illegal to withhold his balance payments. For example,PF balances are payable,bonus,balance pay etc

I agree with Pf balances. also PF balances cannot be hold by employers as the amount is with EPFO. employee can claim it from even without intervention of employer

The Full and Final settlement to be processed even the case exit is of misconduct, checking on the recoveries if there. Kindly let me know if the experience letter can be given or not.
