Hello all,
Its been more than 2 years that I am working for this company. I have got only the offer letter from them. Regarding notice period there is only one clause which is as follows
"You will have a probation of 3 months. If your employment was terminated after probation period you will be given 3 months notice"
Now I have put my papers on 11 march saying that my last day of working will be 18 ,giving them 8 days as notice period. But they refused to relieve me on 18 saying you have to serve 3 months notice period. I had talk with my new company and now they have give me joining date as 28, which is 17 days notice. But still my current employer is not ready to leave me till my new replacement is found. There is no clause regarding my new replacement.
So my question here is can they do that? My new employer won't wait after 28 .
What are my options. My direct manager has accepted my resignation, but have added a line saying regarding releiveing date you will have to serve 3 months notice.
Please help ...

Hello All,

I am working with this company from last 2 years. I have only received offer letter . The only clause regarding notice period is as follows:

"You will have a probation period of 3 months. If your employment was terminated after probation period you will be given 3 months notice."

Now I have put my papers on 11th march and asked them to releive me on 18th. Now they are saying that i cannot be relieved on 18 and i will have to serve 3 months notice period. I had a talk with my new employer and got my joining date extended to 28th so that i will be serving 17 days notice period. But still they are firm on not leaving me. Now they are saying that we can reduce it to 1.5 months till my new replacement is found. There is no clause regarding my new replacement. My new employer wont wait after 28th. So what do i do now in such situation? Can they stop me from leaving based on this one clause?

What are my options? what can be done? My immediate manager has accepted my resignation but have added a line " regarding your relieving date, you will have to serve 3 months notice period"

I also gave them option to buying out my notice period but they are not ready.

Please help me out with this situation..
