Hello seniors,
I'm new in this community, i have one query, i'm working as a hr with it company, my husband is software developer he is working with other company.. we tried worked with the same company. but my husband company hr said ..as per hr policy if partner working in hr department..(means) in same company husband & wife can not working. please clear my doubts. it should be applicable ??

It is not illegal for an organization to have such a policy. There are many companies that doesn’t allow Husband and Wife to be employed in same company

there is no law as such ,this depend upon company policy.you can ask HR to show their policy.secondly why they have recruited you and your husband when they were knowing that you are husband and wife.

the prohibition of hiring of relatives in business organizations is rooted in the concept of NEPOTISM.
nepotism speaks about relationships either by blood (consanguinity) or by marriage up to the 4th degree.
nepotism is seen my many as a potential root of conflict of interest situations, including the crimes of connivance and syndications, esp in critical departments like FINANCE.
companies who allow relatives (brothers/ sisters/ husband & wife) to be hired would make sure that they don't work in the same departments and that there is NO superior-staff relationship between any of them. this is to avoid doubts and biases relative to promotions and rewards.
but, owners of companies (their children and close relatives) are generally exempted by this policy matter.

I agree with above opinions that there is no such law that prohibits such employment.
In fact, many companies encourage it.
However, some companies, esp in Financial sector may prohibit close relatives working in the same department. This is a company policy, to safeguard against any potential malpractices.

It is a matter of company policy.

It is legal to have such a policy of not employing husband and wife in same company.

The employer’s Perspective, can be something like this--- there are all kinds of reasons not to want couples working in the same department or even in the same company.. Will the two of you two work on projects together in professional manner? Will either of you act in a manner that can make coworkers uncomfortable? Will you cause drama or tension if you have a fight or break up? If you have a fight and stop speaking to each other, how will that impact work, where you interact with each other? If your girlfriend clashes with her superior is that going to impact your own relationship with that person? What happens if she gets fired or treated in a way which you/she feel is unfair? Is that really not going to impact your own morale and productivity?

Many questions arise for and against employment of husband and wife together.

Special policies have to be written out for annual reports/confidential promotion reports.A husband cannot give a report about his wife for example.

Coming back to present query-the HR policy will give the answer .Nothing much can be done and unless company makes change in its policy.

Dear Priya,
Pl seek a copy of HR Policy which restrict such an arrangement within company. Spouse/ relatives/ Children etc. can be engaged in the same company however conflict of interest should be avoid.

May be it is correct because some of the companies will frame policies like that.
I have been working in IT manufacturing company in which we do not have such policy,
so we are allowing both wife & husband. Hence, you may understand that the policies
will be varied from one to another.
I can one best example, Once I had been to interview in the company where our
elder and younger brother have been working. The Management said that, as per
company policy we can not take more than two members in one family.
