Dear all,
This is Rahul Vemula working as a HR in manufacturing unit. i have doubht of payment under meternity act Can any one help me regarding maternity payment.
1) how much we should pay for them.(like full salry includes telephone allowence, washing allowence, travelling allowence..etc)

Refer maternity Benefits act;

Sec 5 given below indicates what is to be paid to the lady employee.

5. Right to payment of maternity benefit. -- (1) Subject to the provisions of this Act,

every woman shall be entitled to, and her employer shall be liable for, the payment of

maternity benefit at the rate of the average daily wage for the period of her actual absence

immediately preceding and including the day of her delivery and for the six weeks

immediately following that day.

What is wages is defined in Sec3(n) of the act

(n) “wages” means all remuneration paid or payable in cash to a woman, if the terms

of the contract of employment, express or implied, were fulfilled and includes –

(1) such cash allowances (including dearness allowance and house rent

allowance) as a woman is for the time being entitled to;

(2) incentive bonus; and

(3) the money value of the concessional supply of foodgrains and other

articles,

but does not include –

(i) any bonus other than incentive bonus;

(ii) overtime earnings and any deduction or payment made on account of

fines;

(iii) any contribution paid or payable by the employer to any pension fund

or provident fund or for the benefit of the woman under any law for

the time being in force; and

(iv) any gratuity payable on the termination of service;

(o) “woman” means a woman employed, whether directly or through any agency, for

wages in any establishment.

Wages means basic,All allowances including DA, HRA and incentive bonus, confessional supply of food grains and other articles.

Dear all, Pls explain me regarding the gratuity, In our unit some of our employees completed 5 years.. They are asking me the benefits of gratuity.

Dear Vemula,
Advice you to read the Payment of Gratuity Act.
That will give you a basic grounding.
Commentaries about the payment system,benefits etc are available easily.
Please make an effort to do some homework and then ask specific doubts instead of a generic doubt.

As advised by Mr. Nathrao Please nurture the habit of reading and self learning. That really works. However, I have learnt a lot from this forum. So keep in touch with the discussion taking place in this forum on a regular basis. I Am sure you will get to learn a lot. Nevertheless I am telling you in short about gratuity payment. Gratuity comes from the word " gratitude" and applicable to the employees who have completed 5 years and more of their service in your organization.It is payable at the time of superannuation or resignation whichever takes place earlier. The calculation is equal to (Last drawn basic / 26) x 15 x no of years worked. Hope that will help you.
