Hello Seniors
We are a IT company and hired a candidate. At the joining and documentation collection phase, we got to know that he is the son of a Srilanka's refugee camp currently at TamilNadu. Now legally, he is not a citizen of India, but has stayed in India for last 20yrs under govt recognised refugee camps and has completed his education in TN successfully.His parents are unskilled labours working as farmers
Is it legal to hire him?
As a company, do we need to take any step?
While I understand, he has to be given an opportunity on humanitarian, do we have any threat ?

Hi,
The following need to be noted.
1) If he has stayed in a place recognised by the government as "refugee Camp" then the government has no objection in providing livelihood measures.
2) the very fact that he has been allowed to stay for 20 years and having completed the regular state board education indicates there is an approved domicile status.
3) You may however ask him to produce a certificate of domicile from the jurisdictional tahasildar of his place.
4) In the state of Karnataka, many Tibetans were given specific place for settling down and they are being regularised in main stream.
5) Yes there will be a separate classification of these people as refugees and even they have certain reservation also in government jobs.
Hence this person is eligible for hire.
