When a retired Asst Commissioner of Labour gives reply to your query, it goes without saying that he is far senior person. Against this backdrop, addressing him as "Hi Umakanthan" is highly objectionable. This is virtual HR forum and people of hues, from HR students to retired professionals, are the members. We are neither your friends nor workplace buddies. The etiquette that are in vogue in your industry in general and at your workplace in particular, have nothing to do with this forum.

Cannot guide unless the whole circumstances of your H1B visa sponsorship by your employer. But overall, it is better to sort this out through mutual understanding than litigation route. Legal course on an employee by any employer has adverse impact on any employee, irrespective of the content of the case, hence recommended to avoid.
