1. I have joined a new company in an assistant role with salary Rs. 25000 pm on dt. 19.11.2015.

2. I have recieved the appointment letter on dt. 18.01.2016.

3. On dt. 22.01.2016 I recieved my termination letter with no reasonable cause & it was written as under:

" You are herby informed that your services are no longer required by the managementwith immediate effect. Consequently, you will be relieved from your services.

You are advised to hand over your charge to Mr. X and submit your clearance."

4. In the appointment letter the 3 termination clauses says as under:

Cl.4- In case your services are terminated, you wl be served with 14 days notice or salary in lieu of notice period. A similar notice or salary in lieu of notice will have to be given by you in case you wish to leave the services of the company. The company reserves the right, if exigencies so demand to not relieve you before the expiry of the stipulated notice period.
However, employer is not required to give notice or salary in lieu of notice period if your services are less than 3 months.

Cl.11- Your appointment will be subject to verification of your credentials, certificate and proof of age. This offer is being made to you on the understanding that the facts furnished by your age, qualification, experience are true. In case it is found in future that you had given wrong information or you had tried to hide certain facts, immediate termination will be agreed from the services.

Cl.14- If you are found under the influence of alcohol/ drugs inside the company premises, your services will stand terminated with immediate effects.

5. I am not under the cl. 11 or cl. 14 of the appointment letter in any way.

6. Before taking my clearance I went to meet the management to ask the reason and thanks anyway for the opportunity they have provided me in this company:-

(a) First time when I went there, Chairman and JMD were together sitting in the same chamber; and i was wildly asked by the JMD to go out and wait outside & come after an hour.

(b) I was sitting in the lobby, When JMD was going for the site visit, after looking at sitting and waiting for him- he just angrily asked me to handover all the papers to HR - and said-"I am not going to meet you"

(c)and accordingly I went for clearance and submitted all my clearance report with the HR & moved out of the company being severly hurt within.

7. I took all the pain to do this job although this job profile was not my choice and secondly it was very far away from the place where i stay & killed/ wasted my 3 hrs. daily, thirdly, I was appointed as an assistant, but there was no immediate senior to me of the same trade.
8. I used to wake up at 4.00 o' clock with my mother & wife and take the train of 6o'clock and reach my office on or before 09:30 am- at my office entry time, leave the office place at on or after 6:30pm-at my office exit time, & reach at home on or after 10:00 pm, go to sleep after dinner at 12o' clock modnight and again wake up at 4:00am for my next day office.

9.This is my situation at present, I am hunting for my next job but I am not aware what to say about my termination orders to next company-as because i dont want say the lies so i have to say the truth to the new company- what will be their reaction? & What impact will it give on my career??

10. My aim at present is to join a new company with the truth and file a suit for the above termination and ask for the compensation-as I am feeling that wrong has been done to me.
11. I have explained my whole story to you people, pl. Advice me so that it may be easy for me to join other company at the earliest and file a suit to be compensated for all my pains delivered by me for this company.
12. Please tell me how n where to file the suit and on what grounds- whether I am in right direction or I shall ignore and move away with the present situation and look for the job with the termination letter. Please answer me at the earliest.

I can understand and relate to the kind of trouble you have faced in this company.
What were you doing before you joined this company?
From what I can make out is that you worked only from 19Nov15 to 22 Jan 16-short period of lesser than 3 months.
You need to really think of any particular reason for this abrupt termination and refusal of management to even speak to you.
Seriously think over-any thing done/spoken by you which has lead to the termination.
If you have not contributed to the problem,just take it that company was being difficult.
Have other employees been treated similarly?
Taking legal action is not a worthwhile option here.
Just forget and move on.
This small gap can be covered up in your CV.

Company have terminated you within 3 months, and as per Appointment letter they are not suppose to give you any notice or compensation,though termination is harsh punishment, but no body will understand they why company has taken such harsh step against you. And above all company HR still not give you any written valid reason..in my opinion case against the company only give yor mare pain and harresment to your family...you need immediate relief,try to get a new job at the earliest, you understand that "termination" word having negative effect on your carrer you must delete it from your CV and go ahead in your life. Try to understand the shortcomings,if any, and correct it.

First and foremost, always demand for appointment letter on the date of joining (latest, within few days say 3-4 days). Appointment letter specifies all the clauses of the employment and forms the base of employment. This point if for your future endeavours.

As claimed by you that you are nowhere dubious under clause 11 and 14, it seems like this employer of yours had already made up their mind about termination and hence all the clauses are cleverly mentioned which goes in their favour leaving no room for you to argue.

It is saddening that the efforts you've put in this job did not yield specific results which you planned, nevertheless, its just been few months and you still have chance to make it up. Find good job right away.

It is really difficult to analyse what could have been the reason for such abrupt termination without giving any reasons. Generally clause 11 manifests but you are very sure of it so there is no point in thinking all the whys and whats... even legal action will be waste of time and money for you. It is better that you invest this time and money in finding a good job.

Yes Sir....other innocent employees were also treated equally..and so I decided to resign at the earliest to avoid this situation and about to me only one mistake I did- I shared my views about the company with some of my fellow employees..
