Sir,
I have one more doubt
As per factory act if an worker or employee work more then 48 hour in a week then he should be liable for over time which is double , but if he is from researcher in any chemical company then how to calculate his salary ?
because researcher is person whose work never end . so Please help

His designation is Researcher in R&D department, so his working hour same as others peoples working time.

Whatever be the type of the establishment or the nature of the job, there can not be any work schedule with indefinite working hours. The job of a researcher in the R&D Department situated either within the premises of a factory or elsewhere is no different. Particularly, the general purpose behind the grant of over time work with restrictions such as the maximum limit per day or per week or per month or quarter, payment of over time wages at premium rates etc., is to curb such a tendency of employers extracting excess work from employees whose work is normally measured by time in stead of employing extra labour force. There can not be any comparison between a researcher and an ordinary blue collar workman like a fitter or a white collar workman like a clerk or cashier. The nature of the job of a researcher can not be precisely measured in terms of hours - at times it would be more time-consuming even extending beyond the normal working hours or he can call it a day within the normal span of working hours depending up on the intricacies of the project of research being done stage by stage. Therefore, my suggestion would be flexible work timing with good compensation package to researchers in the R&D is the alternative for over time work.

An employee working in the Research & Development Center is working according to their accomplishment of assigned tasks, somewhere it may be even longer which may not be completed in a particular time , So if an employee stay for a more than 48 hours in week it so may not be calculated s per Overtime Basis.
