My company’s warehouse (under Shop & establishment act) is shifting little far place than the current one. But company is giving conveyance allowance for Rs. 4000/- per month & timing benefit to all employees. But still employee wants to leave the company without giving 3 month notice period & asking for 3 month salary from the company. What should I do??

HI,
when you are offering higher conveyance allowance and revamping the timing, and for which the employee are denying you don't have to pay 3 months salary on lieu of notice period. However you can fix the conveyance allowance to Rs.1600 and increase other allowance. so that the conveyance allowance wont become taxable under Income Tax Act. the exemption for conveyance is Rs. 1600 beyond which is taxable head.

Your management providing so much benefit to employees, but still the employees are not willing to work then i really feel sad for your company staff. Now days no company provide such benefit in relocation matter . Coming to the point if your separation policy is 3 month then staff must serve the notice period to the company if they fail to do you can tell them they will not eligible for full and final settlement & exp certificates. Apart from this no point arise for compensation of 3 month salary to employees except termination clause that also specified in the offer letter.
