Hi Seniors,
I want to understand whether Model standing orders as applicable in the State of Maharashtra and Gujarat are liable to Ceeritfication Since if we see the State anmendment made in Maharashtra and Gujarat, it says where were the word standing order is there it will be Model Standing Order.
Does it basically mean that the Model Standing orders in Maharasshtra and Gujarat needs to be certified.
Kindly provide your valuable view into this

I think that probably you are refering to the application of Model Standing Orders till the certification of the Draft Standing Orders to be submitted. As the very name suggests MSO is the one based on the guidelines on which you have to draft the SO according to your own requirements. It does not mean that it needs to be certified as it is.
The Maharashtra State has framed it' own model standing orders applicable to industrial establishments,falling under it's sphere of control.An establishment has frame it's own standing orders on the basis of the State model standing orders and get them certified within six months of the Standing orders Act becoming applicable to the establishment and till then MSO is applicable to them.

Model standing orders will be followed by the companies whoever is having the employees strength of less than 100 (in TN its 50).
If your organization strength is lore than 100, You will have to draft the standing order in your local language and english according to your company in the format of the model standing orders and submit the same to the deputy commissioner of labour with the consent of your employees / union and the same should have been approved with in not less than 6 months.

if we apply Model standing Order as it is, it do not need any Certification, But what is the scene if we amend the Model Standing Order.

Sec.3 of Standing orders Act lays down that the establishment to which the Act applies, states that any amendment made to model standing orders shall be submitted to Certifying Officer and therefore the amendments need to be certified .It cannot be unilateral.

Nice guidance by all, Well I am from Gujarat and we have more than 100 employees, what should I do...I don't wanna amend model standing order...we want to follow model standing order as it is then it needs certification???? or compulsory we need to amend model standing order and certify form concern authority.
