Reg contract labour employer pf & esi contribution
Hi all hope doing good i have few queries regarding employer pf &esi contributions of contract labour > i have contractor for providing contract manpower to run our plant. for which we are paying him 10 service charges do we need to reimburse him employer pf and esi contributions which he has paid to respective authorities? or he should manage these contributions within the 10 service charge? > is there any provision in contract labour act that principal employer should bare employer pf & esi contributions of contract labour? > till date contractor is paying the contributions and reimbursing the same by adding in monthly invoices by providing challan proofs now my management is claiming that in contract labour act under section 41: recovery of contribution from immediate employer says "a principal employer who has paid contribution in respect of an employee employed by or through an immediate employer shall be entitled to recover the amount of the contribution so paid that is to say the employers contribution as well as employees contribution if any from the immediate employer either by deduction from any amount payable to him by the principal employer under any contract or as a debt payable by the immediate employer" please clarify on this thanks & regards satish kumar k
Change in pf contribution
Dear all need some clarification on change in employer & employee contribution to pf: employer and employee is currently contributing 12 of basic into pf basic being higher than rs. 6500/; and employee now wants to restrict his/her contribution now to only 12 of rs. 6500/ basic ie. rs. 780/ pm. example current basic on which pf contributions are made is rs. 15000 employer s contribution to pf is rs. 1800. this method was applied last 67 years. now both employer and employees existing would like to change this contribution to rs. 780 each basic rs. 650012. can this change in contribution be done without changing employee s ctc? purpose behind this request is that the employee wants a higher take home package. he will get his the amount from his reduced pf deductions plus the employer s reduced contributions as increased take home net sal. what are the implications from a statutory standpoint to implementing this change? appreciate some inputs on this regards prabhakar

Epf contribution, updated may 27, 2014
Dear friends india inc can now limit its provident fund contributions against the statutory salary ceiling limit of rs 6500 per month even if earlier such pf contribution was being computed against full basic wages or salary. the employee provident fund office epfo has on may 27 2014 issued a circular to this effect. under provident fund pf regulations pf is computed at 12 for both the employer and employee contributions against 'basic wages'. the minimum statutory limit against which such pf is to be computed is rs 6500 per month. the employer and employees have an option to make pf contributions on salary payments in excess of rs 6500 per month. in those cases where contributions were made in excess of the statutory limit the issue was whether an option is available to revert to lower levels of contributions i.e.: a contribution computed against the statutory limit of rs 6500. the epfo has now clarified on this issue. thanks kar
Registration under pf act
Dear friends in a ntpc project the main contractor has engaged a subcontractor and offloaded some part of the work. the subcontractor is recovering the pf contributions from his employees and depositing under his pf code regularly. the subcontractors' labors are covered under the labour license of the main contractor. ntpc is asking the main contractor to deposit the pf under their pf code or to issue form v to the subcontractor to enable them to obtain the labour license. please advice me on the following 1. is it mandatory that the pf contributions to be deposited with the main contractors pf code only even if the s/c is having apf registration. 2. whether the s/c should have a labour license for depositing the contribution under his pf code. regards. krishnan
