Hi Team,
I left IYogi Technical Services Pvt Ltd in June 2015.Its been 6 months now and even after repeated follow ups my full and final settlement is pending. The company owes me 3.75 lacs.
Is there no rule that is legally binding to companies that ensures company clear the full and final within a stipulated time. My employee id was Y-7619 and this no fake post. I worked really hard to earn my pay and I guess its unfair to hold ones pay like this.
Please help.

Dear Ashish,

Before replying your query, it is important to know whether the company has issued you Service-cum-Employment Certificate. If no, then first cajole them to issue this certificate.

If you are in possession of the experience letter then I recommend you approaching the labour officer of your area and give him your submission. For this you need to find out where the labour office is. Secondly, your designation also matters. If you are senior then labour officer might not entertain your query. However, going through this office is important. When you approach the labour officer, take with you all the evidence of the employment.

If Labour Officer is of no help to you then you might to go for litigation. However, before this, inform the HR of the current employer and seek their advice. Your current HR should not construe standing for your rights as your belligerence. Possibly HR might come up with better solution.

If HR remains neutral and not interested in what you do with the previous employer then the next step would be to issue lawyer's notice. Thereafter, as such your lawyer will guide you.
