Dear All,
I have a doubut about the bonus payment.
We have engaged some agency for catering services. Whether the principal employer is any way responsible for paying bonus to the catering agencies staff ?
Please throw some light on this subject.

If you will go through Payment of Bonus Act and Contract Labour(R&A) Act, you will find that bonus is payable on every establishment where 20 or more persons are employed.
If you see Contarct Labour (R&A) Act it states that all the responsibilities of contractor is to be discharged by the principal employer if the contractor is not discharging the responsibilities and principal employer in turn can charge it back to the contractor.
Paying bonus to contract labour is the responsibility of the contractor if he has 20 or more workmen. So if contractor has not paid bonus principal employer will have to pay and in torn charge it to contractor.
As a matter of practise most of the companies pay bonus to contract labour but dont charge it to contarctor.

Your replies were very useful. I am also trying to impliment the same as per the Act. I just needed the clarification because we have engaged Canteen Staff and Office Boys through agency. The number is not more than 20.
