My sister is working in Appolo hospital kolkatta for last one year. Now she wants to resign the job due to personal reasons. But the hospital authorities are not allowing her to resign siting the shortage of nurses in the hospital. Since her original certificates are not returned by the hospital authorities she is afraid to quit the job. What can we do now?

Any employer, cannot retain Employee or it’s Certificates forcefully.
Please refer to the terms & conditions related to resignation clauses of employment / contract Letter signed at the time of joining.
Incase, you are statisfied with T&C and there is no breach of contract, tell your sister to speak to Sr. HR Officials and clarify the details. If matter still not resolved, file a complaint against the employer in labour court.
Your issue will be resolved with only little efforts.

If you file a complaint in the labour court, the case will be decided in your sister's favour. You must create proper documentation. So step 1. Send a registered notice to the company, mentioning that you want to resign for person reasons and the company return your original certificates. Step 2. You should get a reply or get relieved after the official notice period, (which might be 30 days, as per appointment letter). If the end of notice period, send a letter to the Labour department mentioning the facts of the case and request their interference. Mark a copy of the same to the company 99%, company will return the documents and avoid a case in the labour court. Please take help of a professional lawyer, and many are available for a nominal fees. This will ensure, that you do not get into some trap laid by the company

First you should thoroughly go to the clause of appointment letter. I am of the opinion that if employee had submitted his original certificate, it means that company has made an agreement also.
However, this matter can be tackled with due respect and and sorted out mutually by telling about future prospect etc. In case even the management is not ready to listen, best out come would be to go labour court shelter for releasing the documents. During discussion, you may also apprise with your proceedings also.
