Dear Seniors, Our company having around 60 employees. In that less than 30 employees are covered under PF. When we enrolled in PF(April 2014), the company has been given the option to employees that they can register or not. Now the questions are:
1. Is it mandatory to cover all the employees under EPF?
2. If not is there any declaration form needs collect from employees.
Looking for suggestions

Dear Madhushree, for your clear understanding a company which is having 20 or above employees earning below rs.15000 then the company has to register in PF that is mandatory.Say your company is having 60 employees out of which 15 are getting below rs.15000 then your company is not eligible for PF.
Only if more than 20 employees get below rs.15000 it is eligible.
An employee earning more than rs.15000 is optional to register in PF.It depends on the employee to register or not.

Dear Archana,
I have checked details of our employees basic+DA. 19 employees drawing less than 15k basic, In that again few of registered with PF and Few of them not. so kindly suggest me as an HR what is the action i have to take.

Dear Madhu,It is the employer part to get all the employees to register in PF if their salary is less than 15K and the company head count is more than 20.This is Mandatory and not volunteer. only for employees above 15k is volunteery.

If the total employee strength is 20+ and even if one employee's wages is less than 15000/- (Ceiling Limit) then it is mandate to enroll with the PF & ESI if that area is under coverage.
I hope now even the employee who's wages is above the ceiling limit, even those has to be covered.
If at the employees wages are above 15000/- and if at all they don't have PF coverage earlier then the entire contribution of 12% or EE & 12% of ER should be contributed to EPF account only. For those employees there won't be EPS

There is no provision in the EPF Act to the effect that only if a company have twenty or more employees with salary not above RS 15 K pm,it need to be covered under EPF. .This concept is wrong.
Please refer to 1(3) of the Act which clearly says that an establishment having 20 or more 'persons' employed is liable to be covered.The word used is persons not employee .The Rs 15 K criteria is coming when we consider who is an employee.
So if the establishment employ 20 or more persons irrespective of their salary , is liable covered under EPF.
