Notice period buyout in it services company - hr is telling me there is no buyout option
I work for a big services it company in bangalore which has 3 months notice period. i have resigned two weeks back and want to buy notice for two months. the hr is telling me there is no buyout option and i have to serve entire 3 months notice period. here s the paragraph from the agreement: " your employment with the company shall be terminable without reasons by either party giving onemonth notice during probationary period and three months notice on confirmation. the company reserves the right to pay or recover salary in lieu of notice period. further the company may at its discretion relieve you from such date as it may deem fit even prior to the expiry of the notice period. however if the company desires you to continue the employment during the notice period you shall do so. notice period and termination of employment contract shall be governed by the applicable internal policies of the company as updated from time to time." can they me to work for entire 3 months on notice when i want to buy notice for 2 months and serve one month. please help
Notice pay in case employee is relieved earlier
Dear all looking forward for your advice on the following issue: our employment agreement has a notice period of one month from either side. one of our employee submitted his resignation and was relieved before the expiry of the notice period as he had completed his project and no new work was allocated to him. he was willing to serve the full notice period but we did relieved him immediatly as there was no pending work from his end. the employee is demanding notice pay in leiu of the remaining notice period as he was relived within 10 days. is the organisation liable to pay ??? after resignation is accepted can t the organisation relieve an employee in advance or late based on the nature of job & responsibilities ? thanx in advance. rekha
Termination without assigning any reason
Hi an appointment letter of a company contains the clause of probation period as follow: "you shall be on probation for period of 6six months and the said period shall be extendable but the total period of probation shall not exceed 9 nine months. in case you do not receive any letter of extension on expiry of your initial period of probation it shall be deemed that the probationary period has been extended by 3 three months. during or on the expiry of the period of probation initially fixed or subsequently extended your services shall be terminable without notice from either side." as per this if the employee was not given confirmation letter then his probation period shall extend to 9 months. in this case if the services of the employee are terminated then is it neccesary to give reason for such termination? can u please quote some source/case law also for your opinion?
Resignation during probation
I know somebody who has recently joined a organisation from where because of some family issues he wants to resign & join a firm near his home. he is still under probation. but the current employer is not giving relieving letter even after my friend is ready to pay for the notice period.instead wants him to serve the notice period.and the new employer wants relieving letter as well to join before expiry of notice period.this person wants to leave the current organisation only because of family problems. please suggest what should be the next course of action.
Difference between notice period waiver and notice period buyout
My appointment letter says any shortfall in notice period can be adjusted in lieu of payment however new policy on notice period says notice period cant be waived off.does that mean notice period can not be bought out
Company is relieving before the expiry of notice period
