Hi,

Need urgent advice.

Case History - I was working with one of the startup company.i joined company on 11th aug,2014. I was working as area sales manager.on 13th april,2015 my business head informed me that company is winding sales operations so he verbally informed me that company will pay sales people 1month salary i.e 13th april till 13th may and we will be consider as resigned employee.

But i got opportunity in other company,so i requested to accept my resignation till 30th april,2015.

Case problem- On my last day of handover, HR told me that i will get fnf and relieving letter after 45 days.

So, i waited patiently for 45 days.

I mailed hr on 22nd june for my fnf and relieving, but no response for 2 days.so i went personally to office and met hr over there, where she conveyed me that i will get fnf in july as informed by director to her. Luckily, I got my relieving letter on that day.

Next day, again i mailed to release my fnf.after 3 days i.e. 29th june. All sales people got mail from HR to submit reports of clients details, as they have appointed new business head.if new business head satisfied with our reports than only will release fnf.

So, i called new business head on report discussion where i requested him to release my fnf 1st then will give you report as i lost my trust on company policies.but he didn't agreed to this condition and said that he will get back 2 me by 10th july.

As expected, he didn't called me back.

So, i sent legal notice to company to clear my dues within 7 days. They unclaimed my notice.

So, i need a strong advice for next course of action.
If i have to file a case, which sections will be applicable.

Please help.

My last day was 30th april,2015 as same has been mentioned in relieving letter.my one month salary is due in fnf.

Dear Nathrao,
Legal notice was issued by my lawyer only.but they sent it back.
My lawyer is practising law, thus she requested me to take some advice from professionals.so, i request you to give some strong advice which will make them pay at earliest.
Note - company director is NRI and he own stake in 5 companies.He is a very egoistic person and he clearly told to one of my ex-colleague "india main jo karna hai kar sakte hai, koi hamara kuch nahi bigad sakta".i took decision to change this attitude of him and want justice for work i did.
Please help.
