Hi, This post is on behalf of my friend. My friend took one year of Sabbatical leave post her maternity leave but she was not removed from the payroll of the company will she be eligible for Gratuity as she has already completed 5+ years in the same company

Hi,
Every workmen who completed 5 years of service will get gratuity ,In each respective years the concerned workmen should complete CONTINUOUS EMPLOYMENT means uninterrupted service which may be interrupted on account of sickness, accident, leave, absence from duty without (not being treated as break in service), lay-off, strike, lock-out or cessation of work not due to the fault of the employee. (Sec 2A).
Now please check your position with the above said definition.
