Hello Friends,

I am having one doubts regarding relieving and exit formalities. Actually I am having 3.6 years of IT Experience. As per company norms the notice period is 30 days. I submitted my resignation to my manager and HR. They asked me to serve the notice period which is 30 days. I began to start working in the notice period, but my manager and HR didn’t tell me the relieving date and exit formalities. I completed my notice period and asked them about relieving date. After lot of mail and oral conversations I got the same reply from my HR and Manager “Please wait we will check and update you”. In the mean time I got an offer from CMM Level 4 Company. I told my HR and manager about this offer and asked them to relieve me. They simply told me to leave that offer and advised me to work for another 2 months. I didn’t get salary too. I described the situation to HR of the new company. He asked me to bring bank statements, P.F No, and resignation copy mail and advised me to join immediately. After completing my notice period and joined in that new company. My old HR refusing to provide the relieving letter and Service certificate. In my new company there is no issue. My doubts are

1. Whether this incident will disqualify me for attending interviews in TCS ,IBM

2. Onsite opportunities

Please help me I am confused a lot.

Yes it will harm to your professional career.
request to your old company HR and take Relieving letter immediately if they are doing any problem you just consult a union or labor department and told them what problem your are facing by your employer.

Hi Arul, in case there is no shortage from your end, your old company cannot hold your exit letters legally. you can approach the labour commission and sent them a legal notice. i have 9 years of experience in IT companies and this pretty well works.

Dear as per certified standing orders/model standing orders it is your right to get the experience certificate which will be required by you in due course.sorry to say that most of the IT companies does not have professional approach and secondly their HR is not having qualified work force.I feel shame on part of HR when they even does not follow law of the land.
please send legal notice through advocate regarding your salary and experience letter and if they donot give after legal notice file case in civil court because labour court may not entertain your case as you donot come under the definition of workman
