Payment of bonus act - am i liable to pay a bonus to my contract labor, eg. canteen staff, peons, drivers?
Hi i have two questions. i work for a service industry and engage in contract labor. the company is six years old and is lossmaking. my questions are 1 even though i am a lossmaking company am i liable to pay the minimum bonus of 8.33? if so can i pay for the back period now. this is our 7the year running 2 am i liable to pay a bonus to my contract labor eg. canteen staff peons drivers etc.
Are contract employees eligible for gratuity after 6 years?
Worked on yearly contract signing an agreement of service for the period one year every time. signed so far 6 agreements without a loss of a single day and hence worked continuously for 6 years. do i can be treated as "employee" for gratuity and signing the contract every year will deprive me from the gratuity? the hr is denying me the gratuity stating that since i have signed the contract every year i am not eligible for gratuity. please advice.
Maternity policy - client is not renewing the contract due to my pregnancy
I m working for idexcel technologies as permanent employee but working for client unisys india as contractor from 1.5 years. the client is not renewing the contract due to my pregnancy and my company is telling if they agree to extent the contract will pay 3 months and 3 months loss of pay for maternity leave. once if they agree for renewal they provide medical benefits if not no benefit. and they will cancel my employment .please advise.
Compensation for contract worker - applicable under employee compensation act?
In one of our fashion store outlets in up a contract employee drawing less than 18k per month has met with an accident on the job. this establishment is governed under the shop & establishment act the accident and subsequent hurt that happened was while the employee was doing routine store work. the employee was on contract with a contractor whom we have discovered had not enrolled the said contract employee under the provisions of the esi act. from a statutory point of view please guide me 1 if such a contract employee is applicable under employee compensation act 2 should the company have to pay for the contract employee under provisions of the employee compensation act considering his wage as rs 8k. also will the company have to pay any loss of pay to the employee in addition to compensation. 3 if the contractor is not fulfilling his obligations under esi act is there any penalty towards the principal employer. 4 does the employee compensation act also be applicable on an employee if he/she decides to work on the day of his/her weekly off.
