Subject: Claim for settlement of monthly pension (as per EPS act 1995) against form 10.D submitted to M/s BGR Energy Systems Ltd, purely based on my eligibility for receipt of monthly pension, ever since 12/10/2012 onwards (i.e. upon attaining the age of 58 years on 11/10/2012) claimed due to absolute and uninterrupted continuity of service for nearly 17 years as a contributor of EPS account through three different employers with effect from 16/11/1995 onwards.
Employment and contribution particulars in chronological order :- such as total service period put in by me through three different companies along with dates of joining and dates of leavings , the respective PF Account Nos and employment code as applicable to each of the three organisations are as noted below.
01 M/s .Simplex Infrastructures Ltd ,worked during period 31/3/1995 to 09/04/2006 ( i.e 10 years , 03 months and 25 days ) with PF Account no: WB/CA/29601/P1842 and with employee code no: 5107 in their payrolls.
02 M/s HCC Ltd , worked during period 15/04/2006 to 24/11/2008(i.e.02 years, o6 months and 40 days) with PF no :MH/BAN/22800/7072/R843 and with employee code no : 6241 in their payrolls.
03M/s BGR Energy Systems Ltd, worked during period 01/12/2008 to 11/10/2012 (i.e. 03 years 10 months and 11 days) with PF no : AP/GR/CDP/19918/3098 and with employee code no: 3539 in their payrolls.
Upon my attaining of 58 years of age on 11/10/2012, I ceased to be in employment with M/s BGR Energy Systems Ltd. whereas it is confirmed that I got full refund of Provident Fund Accumulations. But my form 10 D i.e. application for approval of pension payment, duly forwarded by M/s BGR Energy Systems Ltd was rejected by the office of the APFC, Cudappa under Gundur Division 0f PF, for want of back up particulars of service and EPF contributions from 2 of my previous employers viz (1) M/s Simplex Infrastructures Ltd & (2) M/s HCC Ltd, prior to my joining the firm where I was lastly employed, i.e. M/s BGR Energy Systems Ltd as shown above.
Although I had submitted statutory formats like form 13 and form 10 c EPS etc for transfer of FPF amounts from my employers viz (1)M/s Simplex Infrastructures Ltd & (2)M/s HCC Ltd as narrated above , they are taking unduly longer periods in heeding to my requests in spite of my pursuing them through letter of requests , telephone calls and emails etc. They are neither giving me the scheme certificate nor virtually and effectively transferring my EPF contributions to merge with that of M/s BGR Energy Systems Ltd. Although M/s HCC Ltd is assuring me that they are trying their level best for getting virtual transfer of my FPF accumulations merged with that of M/s BGR Energy Systems Ltd, this is not happening. Same is the case with M/s simplex Infrastructures Ltd who in turn is assuring me that they will get me the scheme certificate to make me eligible for applying for monthly pension. Both these companies ie M/s Simplex Infrastructures Ltd and M/s HCC Ltd are not acting sincerely and they are going on delaying the issue of scheme certificate / and or virtual transfer of FPF accumulations with that of M/s BGR Energy Systems Ltd with whom I was employed with lastly.
Accordingly what I understand is that M/s BGR Energy Systems Ltd is unable to process my form 10 D for onward submission to APFC, Cudappa due to lack of proper feed back from 2 of the previous employers with whom I had worked prior to joining of M/s BGR Energy Systems Ltd.
Now in this context I have taken up the matter with consumer services division of EPFO,Delhi. They have given me a grievance registration no as “CEPFO/P2015/04868” on date 3rd June 2015. Upon my telephonic pursuance they told me to wait till 30 calendar days from the date of registration ie 3rd June of this year.
PLEASE STUDY THE DETAILS GIVEN HEREIN ABOVE AND ADVISE ME AS TO WHAT TO DO TO EXPEDITE MY CLAIM FOR GETTING MONTHLY PENSION .

Dear Mr. R.Vijaya Raghavan,
Where did you submit form 13. Thr' M/s BGR Energy Systems Ltd it was to be submitted. Then the concerned Sub Regional PF Office had to collect the details from previous Offices. After submitting form 13, there is no need of form 10-C i.e for scheme certificate. Also for scheme certificate, form 10C should be submitted to previous Offices thr' previous employers. i.e. You cannot submit both forms to single employer in this case.
For scheme certificates of previous services, fill form 10C, get endorsed from concerned employers and submit to the concerned sub Regional Offices.

Dear Mr. Abbas ,

I had submitted the hard copy of form 13 in respect of both (1)M/s HCC Ltd and (2) M/s Simplex Infrastructures Ltd to my very last employer i.e M/s BGR Energy Sytems Ltd .And the matter of submission of form 13 was also advised by a nodal officer from cudappa EPFO, under the concerned SRO of Guntur -AP . But Ms BGR Energy Systems being a registered member under the online transfer portal were not ready to reckon my hard copy applications.
Then I tried for online transfer of EPF (pension portion) by log- in to portal through the UAN number allotted to me by EPFO and came to know that both M/s HCC Ltd and M/s Simplex Infrastructures Ltd have not registered as members to the online transfer portal and hence cannot be considered as eligible for request for online transfers . This is in contrast with the stand taken by M/s BGR Energy Systems who had updated their records and gone online by registering with EPFO by holding a UAN of their own and hence refusing to act on my hard copy application of form 13.
