Hi everyone,
My friend is working in XYZ office in ABC west for some process and there is an FIR has been filled against her for misbehaving and slapping a police woman. My friend is very bad at her anger once she is getting angry she cannot control herself and do anything even she can hurt anybody. She recently went to her nearby police station to file a complaint against one person whom she doesn't like and she went on an argument with the ladies police and when lady cop was trying to control her she loose her temper and slap a cop (lady constable). The day ended with filling complaint against my friend only. Now she is worried for her career. The police people has not sent an FIR copy yet to her office and she is worried of loosing her job.
I want to know that Can FIR effect her job at XYZ ABC west office? Is ther any law that can lead to termination of her from the Company? Please assist me to help my friend.

Since the matter does not involve any moral turpitude, no disciplinary action can be taken against her. Try to settle with the police constable as the matter appears to be compoundable. She can show her medical history of getting hysteric frequently.Police is not required to send copy of the FIR to private employer.

Dear friend,

Well, you have written story of your friend who happens to be "angry young woman". In the bygone era, there were Hindi films of "angry young man". It appears that she has taken films of this super star seriously and tried to replicate the script in real life. But then life on silver screen is different from the real life. As far as possible, common person avoids visiting police station. There is a unease or hesitation while dealing with the police personnel. But your friend is so presumptuous that she fought with the custodians of the law as easily as she could have fought with classmate in the school.

Anger is one letter away from danger, said Eleanor Roosevelt. The saying has proved 100% true in her case.

Leave aside police personnel, physical assault against anyone is illegal. She has transgressed all the limits. Tell your friend to tender apology of police personnel and somehow withdraw FIR. What police personnel take to file FIR same thing possibly they may take to withdraw the FIR. Generally police do not inform to the employers about the crimes that take place out of office. They will follow their own procedure. Therefore, before the case comes up for hearing it is in her interest to squash the FIR. Tell your friend to take a leave for a month or so and she should overhaul the matter.

The problems of this kind happen because of poor parenting. She appears to be pampered child of her parents. While parents may tolerate throwing tantrums or blowing fuse, society will not.

The second reason why problems of this kind arise is because of dissociation from the religious teachings. What our religion teaches? It teaches us to control Kaam, Krodh, Mad(h), Moh and Matsar. These are the five enemies of human. We should keep them under our control. However, by chance if any one of it starts controlling a person then he/she lands in trouble the way your friend has landed in.

The third reason is misplaced devotion. Religion is for practising. To practice it, one has to listen to the religious discourses and implement in day to day life what is being told. In contrast, young generation feels that religious activities start and end with devotion to some demigod. For them, submission to the demigod is panacea to all the ills of the life be it irascibility or anything else.

After withdrawing FIR (in case if police do it), she must take counselling from a counsellor. If this does not work then she should take psychiatric treatment. She badly needs it and cannot stave off from it any more.

In continuation of the above, it may be stated if the FIR is registered under sections 332 or 353 IPC which are non compoundable then get it quashed under section 482 Crpc proceedings before HC after se ttlement. If FIR is registered under lighter IPC provision like 323 IPC then settle before court itself.
