I would like to know if a person is transferred from Our Indian company on work permit to US and now is on payroll of the US parent company is he eligible for continuation of gratuity in our company and on basic should his gratuity be calculated.

hope all going well.
as per payment of gratuity act who worked continuously 5 years he /she is eligible for gratuity.your company is India based, so you have to follow Indian statutory.coming to calculation of gratuity you have to pay 15 days wages for every completed year.
i said as per my knowledge and i am a student of MBA-HR final year .if any corrections please rectify.
