Hello Everyone,

i need your help, here is my story :

1) sept 14, i got selected in one of the startup company in hyderabad(i am having around 5 yrs of IT exp), during my interview process sr. HR asked me about my spouse, i told them she is a fresher and searching for the job (her expertise is android app development).

2) He said, oh we do have requirements for android developers, once you will be on board we may select your spouse as well. (point : they have initiated this discussion)

3) i joined them in dec2014, in the month of jan2015 i asked my manager that during my interview process HR told me about the android position, So do you have any such opening, if so will you take my spouse interview as well.(i didnt asked them to do a favor, i asked them to screen my spouse before taking her on board).

4) they said yes we do have requirements, and they interviewed her and decided to have her on board in the month of march2015 and released offer letter for her in jan2015.

5) in the month of april2015 i resigned because they kept me on bench for more than 4 months, next day they relived me. its fair enough,

6) But they relived my spouse as well by telling her that they have no requirements for android developers so releiving her, totally unfair, if they were not having any such opening then why they took her on board, they relived her just because i resigned, they are treating it as presonally not professionally,

7) it a loss of her 5 months, and its totally illegal to do this kind of thing, please suggest what i can do in such situations.

Hi,

I can understand your frustration to have lost jobs for both people in the family, & it may look unjust from one point of view; but it's the struggle in life & sometimes we have to accept it.

If you have left the company thinking that you could still depend on her salary for income, then the reason behind this unrest is your 'career choice risk' & not the company's 'Illegal termination issue of your spouse'.

Since they relived you in 1 day & relieved her without notice, it seems you do not have any contract signed for reliving period. In that case, it is not illegal to terminate the employment contract from company, given due reason.

If the company has said that she is relived due to "No further requirement" to the organization, then that's a fair reason. She can pursue her career further without any dent on her professional record. Why are you so much worried about what the actual reason would be? She has gained experience & salary for 5 months. How can it be waste?

You said you were on bench for 4 months... It may be the fact they really do not have work, & were retaining her just because they were retaining you. The priorities for her release over other employees might have been increased, when you left.

I really do not think you should argue, or can win this argument with that company..... Sorry for that!
