Respected All,
I am working with a consultancy firm as Recruitment Officer since 9 Months and got an opportunity from other firm as HR Executive in generalize profile.
The current organization I am working in has a line mentioned in my offer letter that "You have to serve he company for minimum period of 1 year".
The other company which has offered me, is willing me to join in 2 days.
The current company is not ready to accept my resignation and I am very much interested to join the other company.
What if I sent a mail resignation letter to the concern person in current organization and join the other company on next day.
(Note: please note that my current company has given me the salary of the previous month.)
Please Help & Suggest.

Also the offer letter of current company didn’t contain any specification regarding the notice period.

Will your new employer accept you in this quick exit mode from previous employment?
Your present company cannot compel you to serve for one year.
Courts generally rule in favour of employees in case of ambiguities in employment contract.
Was there any clause for payment in case of early exit?

No one can do anything if you dont want to work. You can abscond also. Did the company you joined trained you? As you said they are paying you also.
Would you be feeling happy if the company guys had terminated you with one day notice saying that you are not performing?
It should be ethics on the both sides. HR world is so small, you would be seeing the other people very randomly, so be wise while you decide.

Hi Harshil !!
The current organization I am working in has a line mentioned in my offer letter that "You have to serve he company for minimum period of 1 year".
Can u just check the apponint letter once again. In case only above line mentioned in ur appointment letter, then U R at liberty to leave the current organization as per ur sweet will.
But make sure no other lines are mentioned in ur apptt. letter or reference of some other documents may not have been linked/attached. In case, U still have any more query, may like to contact thro' mail id

Hello Mr Jatin Maini,
Yes I checked the offer letter again and the only line mentioned in that letter. No Appointment letter was provided by employer.
Second thing I would like to ask all...
I left the organization without serving notice period or completing my one year service.
The employer recently sent me a formal notice through an advocate raising claim of 40,000 /- amount as penalty.
As I have mentioned before that there is no single line mentioned in the offer letter or any other letter regarding the penalty or notice period service.
The notice he sent is not on any legal paper or letter-head of neither employer not advocate. It is printed on normal A4 size paper and that too came by courier and not through "Register AD"
Need Your guidance for the same....
