Dear Seniors
I have been working in Gujarat based NGO. Recently Government of Gujart has increase minimum wages by Rs. 10.40 per day. Now minimum wage in Gujart Rs. 278.40 per day for Unskilled workers for zone II. Now monthly pay is Rs. 7238.40 for unskilled workers.
I go through Notification of Gujarat Government dated 26 December 2014. There is various category of schedule (Like employment in drilling operation, Hospital, Employment in Electronics etc.)
I did not find any schedule for NGO.
Does minimum wage act of Gujart apply my organization (NGO) or not.
For Example if I recruit any lower cadre employees (Sweeper) and we shall decide his C TO C Rs. 5,000.00 (Including all perks) per month. Gross is 4800.00.
Does my organization violate the rules of minimum wages?
My NGO registered under Bombay public trust act, 1950.
Please guide me.

Dear Saurabh ji,
You have not mentioned the activity or nature of work by your NGO.
Criteria for applicability of Minimum Wages Act is, not the establishment is NGO or not NGO. The criteria is Schedule employment i.e. nature and activities of your establishment / industry / NGO.
Applicability of Minimum Wages Act to NGO will depend on its nature and activities. In case, the NGO perform activities, which falls within the ambit of Scheduled employment / industry as described in Minimum Wages Act, the Act will apply. Otherwise not.

Dear Mr. Keshav Korgaonkar My NGO is Grass root level NGO. We have been providing primary human health at grass root level. Our working area is Central Gujarat. regards Saurabh

Dear Saurabh,
First, do you have registration certificate under the shops act? If no, then the act will not be applicable to you. Nature of your work will also not come under any scheduled employment. On this count also the act will not be applicable to you.
