Hi Guys, I worked in XXX company from Dec 2012 to Feb 2015. Due to my health issue, i took 3 months leave and went for treatment. As the issue was so serious, its took more than the time (1 year) which they gave. But they called back after 3 months and asked me about my rejoining. But as the situation was tuff, i told them about the issue.
But they told me come directly to the office . As i was not able travel that time, i didn't go. After 1 year, when treatment got over i called HR and asked for my Experience certificate. As i am feeling somewhat better than before, i was planning to search for some job which suitable to my health issue. But they didnt reply back anything. Suggest me to get experience certificate

Since the employer granted you leave but later on called you back also after 3 months, but your inability to join at that time does not lead that you have been discharged from services. It has to be through formal letter after following normal process. Better send a registered letter for joining the duties enclosing the medical certificate and fitness certificate of doctor. Wait for their reply. You are entitled to get experience certificate only on discharge from services under shops and establishment Act.

Even after that I called my manager and explained everything. He too accept that and told me that he will help me in this concern . But he said, "Experience letter is purely depend on HR, I am not able to do anything. If HR peoples ask any suggestion from me, then I will help you out in this and mail those medical documents to HR and me with proper reason". I mailed those documents to all of them 20 days before, still I didn't get any reply from them.

Experience Certificate called for the period you have worked for, and employer can give you the declaration for that period only.
It is acceptable that you were on leave due to your health issue and your employer allowed to take leave for the reason too, but they cant provide the experience certificate for the period you were on leave or was not working. You were on record officially but were not working is a truth which you also need to understand.
It is good that you have recovered and now looking for a job and I believe the experience certificate for the actual period you have worked for is enough to help you. You can supply your medical history and other required documents to your employer and they can mentioned the work tenure including the allowed leave to you till the day you were officially on record with them.

Thanks for you suggestion.
Actually i was asking experience for the period which i have worked. I didnt include the leave period also. I joined on dec 2012 and taken leave from Feb 2014 to April 2014.
Its enough if i get experience letter from Dec 2012 till Feb 2014.
But they didnt provide for this much time also. I am keep on calling from Past 15 days they didnt even attend my call.

You are entited to receive the work certificate for the period you were in actual service. You would have an appointment letter when you joined. Further your leave has been approved and you would have sent a letter even if there is no confirmaiton from them.Even if they had terminated your service, they should have sent a letter to your last known address.Was this done? You should send a registered letter to the company requesting them to send the experience letter and also seeking the balance details with regard to your EPF which also needs to be transferrered to the new employer as and when you get employed !!

Actually i was in the mindset that I dont want EPF and all. Only i need Experience Letter which is useful for me to get job further.
But they are not even considering my Suitation, Problem and even not my life.
Really i was feeling sad , when i think that i worked under these guys.
As of now i sent a mail with detailed explanation and medical proof as attachments.
After 1 week , i sent a remainder mail also and weekly twice i was calling my HR person.
But wats the result means, i am not getting reply yet and they are not attending my call also.

If anymore i need to do means, Kindly Let me know.
I am ready do that also.
The only thing that i was not able to do is Travelling.
Doctor advised me , not to travel long distance. If thats not an issue, i would have went directly to office.

send a resignation letter to the concern, and ask them to relieve me immediately and settle the dues if anything. ( relieving letter, service certificate etc..)

If i asking releiving letter or experience letter , they are telling that you already marked as Abscond....
