Notice period - company is not providing the buy-out option
At the time of appointment in june 2013 it was mentioned in the offer letter that i need to serve a notice period of one month if i put my resignation . but company has revised its notice period policy to serve 3 months in june 2016. mentioned in email : for the purpose of terminating this employment either party will be required to give notice of three months in writing or salary in lieu thereof to the other party. i ve kept my resignation recently am ready to serve one month and pay the rest but company is not providing the buyout option. am i eligible for 3months notice period ? please suggest me how can i proceed legally ??
Termination withour notice period or compensation
Hi an employee in my organisation has put in his papers and is willing to submit one month notice period as per the terms mentioned in his appointment letter. however the company does not want him to serve a notice period and wants to let him go with immediate effect. obviously he is only willing to go if he gets compensated for the same again as mentioned in the appointment terms the company refuses to pay off his notice period. what can be done about this?
Applicability on old employees if i change notice period policy in the new policy manual?
Hi everyone greetings need your help i m making a policy manual regarding hr policies. i m adding notice period as well. i wanted to mention the policy in the following manner: "notice period on both the sides will be as mentioned in the appointment letter". however in the appointment letter the notice period is mentioned to be 1 month on either side but does not specify probation and confirmation which i feel is not suitable. so now what to do? please suggest waiting for revert best regards insiya

Dear sir iam working for an x company i have told my company please release me as per the company terms and conditions of employment mentioned in my appointment letter. in my appointment letter the terms are writen are mentioned below i need to give three months of notice period or else i need to pay the salary for which notice priod is not served if company doesn t not want the employee to serve teh notice period the company would pay the notice period. i am ready to serve the company for 3 months notice period now the cmpany is saying verbally that you will have to serve one month of notice period and pay the company company for two month of notice period. can you please guide me on this
Reviewing manager not accepting notice payout option in appointment letter for early exit
Hi all due to internal situation of the teammy manager is not ready to relieve me within the actual notice period. i respect his explanation. however i m in a situation to leave the company after serving half of the notice period. it is mentioned in my appointment letter also that i can serve notice or payout for the notice period and no need to provide any reason. however internally neither hr or my manager is agreeing to this and stating that the approval is needed.since i have initiated my resignation via tool and mail mentioning the expected exit datewill it be considered as termination/abscond if i leave before serving complete notice period.and i am worried if i get a negative feedback from this employerthis will impact my employment with other employers. note: 1. my decision to move is due to personal situation 2. my new employer is not flexible with joining date due to some dependency with their customer 3.i have notified my manager formally for my resignation and i m leaving after serving notice of 30 days where my actual notice is 2 months. 4.i want to make complete my exit formalities without any issues for me or my present company.
