Notice pay not paid
Hi i resigned from my services on 24/2 thereby mentioning that i am ready to serve full 45 days notice period. on the same day the company processed my full n final settlement but did not pay me notice pay. i resisted for this but they said if i did not accept fullnfinal without notice pay they may not even pay my other salary components. under forced circumstances i have no other option but to accept it. i wanted to know if i can get my notice pay recovery from them as it is clearly mentioned in my offer letter.

Immediate relieving from notice period - what is the liability on the organisation?
We have an employee with contractual period of 5 years. he has completed 3 and half year. due to some reason he has been given a notice period of three months by the organisation as endorsed in the contact of appointment. now after 20 days since he was served with notice period he comes and request to be relieved with immediate and salary of the rest of the notice period 2 months and 10 days. the query is a on his request if the organisation relieves him with immediate effect what is the liability on the organisation does the organisation have to pay salary of balance of the days 2 months 10 days or b as he is giving in writing in a way he is resigning does he have to pay three months salary?

Anonymous subject resigned from the company giving no notice hi i had been working in a consultant company for 3 months in the appointment letter is mentioned the clause that i need to serve a 1 month notice period before resignation. now due to some personal issues i have resigned from the company giving no notice but i have sent them a resignation letter. they are asking me to pay back my 1 month salary inspite of working there till the end of the month and later repeated reminders regarding the salary. i am currently not employed anywhere else. can i do something regarding this. please hlep me
Help - notice period waived off
Dear all i need help of all you expert people. i had resigned with 12 days notice period instead of 90 days which is as per the company rules and policies mentioned in the appointment letter. the day i resigned same day my head of the dept. sent the letter to hr dept writing that he has no objection if i relieve in 12 days. after completing my handover in 8 days i have submitted all the papers like exit form etc. the same day i got an email from hr dept where it was written that i have to pay salary for 78 days. on the same email i requested to waive off my notice period because i had resigned because of financial reasons. my boss verbally commited me the waiver off notice period the day i resigned and he has sent a request to hr dept for waiving off my notice period. till the last day of my employement i didn t get any full & final where my notice period waiver was considered. later on i got an email in my personal id where it was written by hr that we cannot waive off your notice period and they are asking for 78 days salary. which is around 60000/ now the hr dept is telling me that they will go for legal case if i will not pay the salary of 78 days. please help can they do legal case. i was the most junior in the dept given my complete handover i had taken the no objection from my head of dept. i had taken the loan from the company which they had adjusted with my 16 days salary for which i don t have any issue as it was an salary advance which should be adjusted. but now they are after me that i have to pay them the notice period. help what i do? do i have to pay them the
Can we terminate a resigned employee for absconding?
I am a part of a software firm mnc headquartered in maharashtra that has a notice period of 3 months. one of our employees resigned on basis of personal reasons and mentioned his last day to be 10 days later. on 14th day he sent an email saying he cannot continue and left. he also mentioned that he did not have any pending handovers and company properties and asked to do his fnf by taking salary in leiu of remaining notice. we have sent him show cause notice 2 times and he replied back saying that he has already resigned and wants us to relieve him and we are harassing him by forcing to join back when he is ready to pay the notice pay. we do not have notice buyout policy. i want to terminate this employee to set an example but have a few questions 1. what can he do legally in this case? 2. can we terminate him on grounds of unauthorized absenteeism?
