Dear All,
Hi i am working with a company which deals in solar energy in Lucknow for that we hired the technicians/helper from the other manpower solution company. I joined this company recently and earlier i was in gurgaon. Which i checked with Manpower solution company they are not deducting the ESI for the employees which are having gross less then 15000. They said that ESI is not applicable in the areas where they are posted in Hardoi district which is also in UP. But i said they are hired in Lucknow and lucknow have ESI hospitals so why they are not deducting the ESI as it reduces the uncertain liability from the employer and gives the benefits to emplyee also. Whether we can deduct the WCT in place of ESI in LKO.
Can you please help me...

1. Sir, all employees engaged on contract basis and working in any covered factory / establishment situated in implemented area viz. Lucknow are covered and coverable under ESI Act, 1948 and rules/regulations framed thereunder. The contractor employees will be coverable alongwith the main employees of the factory/establishment for which they are working till the period they continue to work in the said factory.
2. In case the contractor employees are working at any other place place viz.in Hardoi, as you have mentioned, it will be more better if you may confirm from the Branch Office Manager/SSO of ESIC of your area whether the said area (Hardoi) is implemented area or not and decide the issue accordingly.
