Hi
Pls Solve Follwing problem?
What if an employee while joining establishment has a basic salary of Rs 4200 and after some period of time his basic salary increases above Rs 6501/-, does he have an option to terminate his member ship form the Provident fund act?
In case after registering the establishment at any point in time, the number of employees working in it becomes less than 20 then will the Act apply ?
Are the persons employed by or through a contractor covered under the Scheme ?

Dear Vishnubn,
Those employees registered with EPF have to continue in PF even if their salary increased ceiling limit, number of employees become below 20 etc.
If the principal employer registered with PF, employee in contract is also has to get registered.

Dear vishnubn,
Answers to your questions to the point are as under:
Once an employee is a member of PF, he remains as member of PF even his salary crosses the threshold salary limit.
Once the Act is applicable to an establishment, it continues to be applicable even the number of employees falls below threshold employee limit.
Yes, a person who is employed by or through a contractor is also to be covered under the PF.

You have rightly been advised by the members. In both situations PF is applicable hence should be provided.
