Greetings to All d specialist
My name is DD working for an Insurance firm since 6yrs n 8 months.In July I hd undergne a Hip Surgery fr Necrosis. I hd markd a mail to every1.Now after 6 months my surgery failed n I hve to redo a surgery. I also tried joining my office in Nov bt due to severe pain hd to stop gng to office. My new boss said der is no vacancy so u resign n so has d Hr.I am facing a severe Financial problem bcse I was on Sabatic leave.LWP.
Please help me dig out of this problem n my corrective measure

Pl specify the nature of your organization whether it is a private or semi government. What are the nature of your duties, designation, appointment conditions, your tenure, if any, rules of company on the subject if any.

First submit a carefully drafted gentle communication addressed to good offices of appointing authority,MD,Chairman narrating that you have been on medical leave and Mr/Ms........designation.... Office address......on dated....
asked you to resign and request good offices yo intervene and ask all concerned to not to ask you to resign or terminate......
Record such calls meetings....and submit minutes.....
There are Supreme Court of India judgements that employee can not be terminated even if on prolonged leave.......
Build proof of demand of resignation and submit bed rest advice by doctor regularly...

Really appreciate you guys taking time to study my case so closely.
Below are my job details,
Company Type Private
Vintage 6 Years n 4 months frm last working date7th July 14)
Designation Sr Executive -M2
Nature of Work Back office n Operations
Dept Contact Centre
Job Responsibility - Quality
Apart frm the above, do I maintain all the Emails, records n documents sent to Hr.
Currently its d Sr Manager whos asking me to Resign with the head of Operations n my boss marked on dat email.
I am also suprised if they are asking me to Resign.
My new boss is not at all supportive n Helpful.
He is urging me to quit by sayng der is no vacancy
Should I also mark a mail to her higher ups.
Please Advice

Looking into your nature of duties, these are mainly clerical nature as you maintain records. Thus you covered as a workman under ID Act. Since you have worked for more than 240 days in a year and besides you are treated to be permanent under Shops and Establishment Act for having worked for more than 6 years, your employer cannot retrench you without following the principle of last come first go even if there is no vacancy. If they have to remploy on your post, you have to be given offer firstly.If you belong to Tamil Nadu you are further protected under TN shops and Establishment Act.You need not resign from your job. Further your employer cannot terminate you because of these medical grounds.

Dear Sushil Boss,
Good to see some strong clauses favorable.
Also whats important for me to knw is when should I mark my final mail.As of now I am takng a 6 weeks bed rest by Dr who operated me.
Should I mark the higher ups also in a requesting format.
I am quiet happy to see ur response.

Dear Dindayal,
Instead of sending mail send registered letter to higher ups requesting you to grant leave on medical grounds referring to and enclosing the medical certificate of the doctor and if possible of the doctor of the civil hospital. Also state that You are being illegally forced to resign by .... who told you so on dated. Request that medical problems can crop up with any human being but that should be ground to throw out a devoted employee.

Dear Sushil boss,
Is der a possibility wer der wud re- employ me and later put me in a dept where I only get frustrated n resign.
Because der r teams like Underwriting n New Business wer pple hve gone fruatratedn quit.
They mke dem wuk n sit till late hours beynd 10-12.
Once I get close to recovering I will send d Reg Letter n see der reaction
