Dear seniors,
Iam working in a Textile industry as a HR payroll executive. My factory is located in Tamilnadu.
My doubt is in NH/FH payable.
In this month Jan-2015, we have 2 Festival holidays for pongal on 15th & 16th
one National holiday for republic day on 26 th.
We declared the leave on 16th and we dont run the factory on 16th.
But remaining two days i.e, 15th & 26th we run the mill.
We are ready to pay double wages for 15th and 26th if an employee come to work on those days.
But my doubt is if an Employee is not came to work with out any information on 25 th and 27 th is he is eligible for getting that national holiday wage ?
any Prefix suffix rules is applicable for this Extra wages
Please guide me

I hope you had raised a Form V A to the inspectorate authorities for prior permission to work on national & festival holidays or else your factory will be penalized.
However, Workmen who were 'Absent' on a National/Festival Holiday' will be admissible for leave with pay. Workmen who were 'Present' will be paid double the salary. Also, prefix/suffix rules will apply, without doubt.

So, according to you, anyone absent on both 25th and 27th will lose salary for 26th under the sandwich rule. I hope i am understanding the problem correctly.

There is no pay deduction on both 25 Jan (Sunday - Weekly Off) and 26 Jan (National Holiday). As for workmen who were absent on 27 Jan, their leave will be deducted. For temporary workmen/contractual labor their payment will be deducted for being absent on 27 Jan 15.

If you are absent on 25, 26 and 27th jan.15, your salary for only one day which is 27th would be deducted. The company can not deduct your salary for 25th and 26th in any case. Had the company asked you to come on 25 and 26th Jan and you had not come on these days, the company can ask for your explanation but can not deduct your salary.
