Dear Seniors,
As per Section 51 of Factory Act, 1848:
51. Weekly hours. No adult worker shall be required or allowed to work in a factory for more than 48 hours in any week.
And in As per Section 54 of this Act,
54. No adult worker shall be required or allowed to work in a factory for more than 9 hours in any day:
I am here confused with both the above sec. of Factory Act,1948, because as per Sec. 51 say, A week it means 6 days if we will divide 48hrs by 6 day is will be = 8hrs in a day. as per this no worker should work more than 8 hrs in a day in factory.
but then why Sec. 54 says like that, No adult worker shall be required or allowed to work in a factory for more than 9 hours in any day.
both the section are not clear to me.
pl help me to understand this.

Sorry by mistake I mention Wrong year of Factory Act 1848... it is Factory Act, 1948.

Section 54 comes into play when your requirement needs to engage workman as per shifting arrangements( one shift/two shift/three shifts a day or working 6 days/5 days/5.5 days a week) . For example, if you wish to perform overtime by the workman, then you can not ask him to work more than 9 hours duty (including Overtime) in a day.. This is a simple restriction that a workman can not be made to work more than 9 hours in a day.

More than 8hrs/day=48hrs/week OT shall be applicable. And there is a cap on OT hours as noted by you.

Dear Sir,
As you say, "you can not ask any worker to work more than 9 hours duty (including Overtime) in a day" but as per my knowledge, Maximum OT hrs in a day is 2hrs. If any worker works 8hrs and 2 hrs (total 10 hrs) overtime in any day, then i don't think it is violation of Act.
pl correct me if it is not like that. and I am still not clear about both of the section 51 & 54 of Factory Act, 1948.
