In our organization, we came across a case: We have an employee who has completed 5 yrs within the organization on 26th In our organization, we came across a case: We have an employee who has completed 5 yrs within the organization on 26th December 2014 but he has already resigned on 1st November 2014.
His last date of working is 13th Jan 2015.
So i am having confusion that whether we need to pay Gratuity to this employee or no as he is serving notice period currently.December 2014 but he has already resigned on 1st November 2014.

Dear Dwitija, Service is the duration between joining date and relieving date (last working day). Hence date of application for resignation is immaterial. Abbas.P.S
