Dear Sir/Madam
I am so confused for ESI. Where ESI is applicable and where it is not. If not applicable, why it is not applicable according to the act. As I am working in Construction Co and we are not following ESI just knowing the fact that where BOCW Act is applicable and no need to follow the ESI.
I am not totally aware wages definition in PF act and Diff between PF, ESI and WC Act.
Hence, You all are requested to brief me about the above, I shall be highly grateful to you.

1. Sir, I will suggest you to go through the provisions of Acts and rules/regulations framed under the Acts as mentioned by you in your remarks as above. However, after going through the said Acts etc., if you have any doubt or enquiry about the relevant provisions, then you may raise the same.
2. The topics in the Acts as mentioned by you are very wide and it is difficult to make one understand the same until and unless the matter is examined in consultation with various provisions of Acts as above.

1. Sir, I will again suggest you to go through various laws relating to ESI or Constructions industry to find out the reply as to why ESI Act has not been extended to the construction industry.
2. I may, however, will like to mention in brief that under ESI Act, the appropriate governments under section 1(5) are empowered to extend the provisions to other classes of establishments and perhaps construction sites are treated as separate class of establishment. Hence not covered under said Act.
3. However, the offices of construction units located in implemented areas, being qualified as "shop" and repair and maintenance work being done in covered/coverable factories/units are also covered/coverable under said Act.
4. For furter details, I think, you will get enough information from the website of ESIC and from this site, you can download the material as may be relevant in the matter.
