Dear Experts, I am working in a Pvt Ltd Co. based in Hyderabad. My take home salary is Rs 21,500/-. I have no ESI facility. Our company is not providing Sick Leaves to me. There is any government order regarding sick leaves to employees who are not covering under ESI. Please help in this regards to letting know this to our management.

Sir,
1. In case the company in which you are working is covered/coverable as factory, then the leaves including sick leaves will be admissible to its employees as provided under the Factories Act, 1948 and the rules framed therein by the appropriate State Govt. You can download the Act and rules online from appropriate website of the government.
2. In case the company in which you are working is covered/coverable as an establishment, then the leaves including sick leaves will be admissible to its employeees as provided in the Shop & Commercial Establishments Act of the appropriate State Govt. and rules framed therein. The copy of the Act and Rules can be downloaded from the State Govt. website in which your establishment is located.
3. After studying the provisions and your entitlement to the above type of leaves, you can decide accordingly.
