Hi, This is Darshana. I am new joinee in the newly established Company. Company is established in July 2014.Only 5 Employees are working here. Salary structure is also simple with only Professional Tax deduction. Please Let me know whether the PF Act is applicable or not, provide me the details of introducing PF in the company.

PF Applicability:
The Employees Provident Funds and Miscellaneous Provisions Act 1952 applies to the
whole of India except the State of Jammu and Kashmir (Section 2). This Act applies
(Section 3) to:
(i) every establishment which is a factory engaged in any industry specified in Schedule I
and in which 20 or more persons are employed, and
(ii) any establishment employing 20 or more persons or class of such establishments
which the Central Government may, by notification in the official gazette specify.
The Central Government through the Employees Provident Fund Scheme 1952 {Section
3 (b)} has specified the establishments covered by the Act. Click here for the complete

Darshana if number of employees is more than 20 you are mandatorily required to register for PF You can even voluntarily go for the same if your company requires
hI Darshana,
Your company is started recently with a strength of 5 employees. As per the PF act this strength is less than the 20 and at present you need not required to go for registration. In case, if you have any proposals for expansion of the establishment, then the employees strength exceeds 20 or more on any day, then your establishment is required to register. Please note that this strength is includes of all class of employment whether direct or indirect. I advice you wait till such time you reach the strength to 20 and then go for registration of establishment under Employees Provident Fund Scheme, 1952.

Dear Darshana ji, I would just like to add to other contributors. It seems you are from Mumbai, Maharashtra. You have 5 employees on your roll. To you, MLWF is applicable.
Hi Darshana,
As per EPFO rules & regulations, you can register with the PF office, but you can't disburse the amount to the EPF office unless you have minimum 20 nos of employees working in your organization.
