Dear all my company is registered under the shop and establishment actmumbai . is the minimum wages act applicable to us ? do we deduct pf and esic from the prescribed minimum wages or are they to be kept separate from them ?

The minimum wages act is an act to enforce minimum rates of wages in different scheduled industries. this act empowers the state government to fix minimum rates of wages to employees employed in different industries. this act makes it obligatory on the part of employers to pay at least the minimum rates of wages as fixed by the government. the payment of wages act is an act to regulate payment of wages by fixing wage periods modes of payment of wages and restricting the deductions from wages. as such an employer has to fix wage period and in no case it should not exceed one month. similarly the employer has to pay wages in currency notes and not in kind. the act also gives a list of permissible deductions and any deduction which is not provided in the act will be deemed wrongful deduction. regards madhu.t.k
Is it compulsory to pay minimum wages as prescribed since many companies are not following it in practice?
Dear experts it has been observed that in spite of minimum wages rules and regulations by the state authorities and by the central authorities meaning companies do not provide wages as per minimum wages act. i found in many companies the salaries are far below than the minimum wages prescribed in the notification. my questions are: 1. is it compulsory to pay minimum wages as prescribed since many companies are not following it in practice? 2. the minimum wages prescribed in the notification are basic or gross salary? 3. do minimum wages change as per the skill level of employees? 4. many small companies do not afford to pay the salaries as per minimum wages act. so how much company should face this problem? kindest regards
Minimum wages split up
Hi as per minimum wages act of west bengal for unskilled for zone a current minimum wages is 7661. my question is this 7661 will be treated as fully basic or it can be split. as per my observation in minimum wages act i am unable to find out whether minimum wages will be fully basic or it can be split up. for the above aspect if you have any notification plz share the copy for clarification.

Dear friends as per the minimum wages act minimum wages specified by the state government for the schedules categories of establishment are required to be paid. i presume this act applies to the casual employees and not for employees appointed on monthly basis and for such employees there is no minimum pay. i also presume for the employees under the purview of minimum wages act no epf contribution or esic contribution is required to be paid. please confirm my view. with regards b p rao
