I have visited this site and i found that i can get a better solution here. so let me tell you my concern. i have appeared for a interview at hcl and i got selected. hcl hr asked me that how soon i can join. i told them that i have to serve one month notice period and after that i will be able to join hcl. hr agreed for the same but after a day i met an accident and i hadn't served notice period yet. i was on leave i went to HQ (organisation where i was working} after 14 days and only 16 days were left. i asked my manager to resign immediately saying that i have medical emergencies i have to take further treatment for my leg which was fractured. so he got agree.

HQ hr and manger they got agree for my resignation they said that they are accepting my resignation due to medical issues and they said that they will give my relieving letter after 45 days. they also warned me that if i join another company within next few days in that case they will give negative feedback if they do cross verification. they sent me a email on my email id that my resignation has been accepted and said that they do not give a hard copy for resignation acceptance. so now i have an email from hr that they have accepted my resignation.

my questions are:

1. if HQ can give negative feedback if hcl does cross verification for me.

2. if HQ give negative feedback. will hcl fire me.

3. what i am supposed to do now.

4. after how much days hcl do cross verification usually.

please suggest me something best.

Your HQ HR said that he will give negative feedback if you join new organization in next few days. But he has not said you not to join at new place once you get well. So you can join HCL once you are alright. You can call up HCL HR person and tell them that you have met with an accident and will join a weak later or if you are completely fine right now then you can even join at the earliest. You can talk this matter to HCL HR person and ask them not to crosscheck with the previous employer right now as you have not informed them that you are joining at HCL. You can ask them to cross verify after few days of your joining. Regarding your resignation, you can take print out of that mail and show it to them.
Moreover you will get your relieving letter after 45 days then you should not worry. You can tell this to HCL HR. Relieving letter itself shows that they have accepted your resignation.

thank you roshani this information is really helpful for me. but i want to clear a few more things. if hq have right to give negative feedback as they have already accpedted my resignation and I have asked hcl hr to delay joining but she has denied because it is already too late and I think if i ask them to cross verify after a few days they will take it as negative they will think that I was not loyal with my last company and all they can even find something fishy. but I havent done anything wrong.

see u have not served the notice period in ur previous company for 1 Month that is why they might be saying u that they will give negative feedback. you dont have directly to say hcl HR that dont verify now. You can tell them dont cross verify as soon as u join as your previous employer may not do full and final settlement Also will not provide you relieving letter on time due to your accident u could nt served notice period of 1 Mth and u have requested them to release early from your service due to medical issues.
if hcl is not allowing u to join late then you go and join on the given date and do your documentation part. Request them to allow u to leave early on the day of ur doctors appointment. Also take your medical certificates with you to show it to them.

firstly , if your previous employer send the acceptance letter from their Official e.mail ID then it is very much legal and valid. You need not required to approach them for the hard copy of acceptance letter after 45 days. Now e.mail correspondence is accepted by Court also....So HCL should accept the same if they understand Law. So, don't worry for the hard copy of the relieving letter. E.mail is very much official.

Secondly , you can show the e.mail acceptance to HCL HR and request them to take feedback after 45 days...also please describe the whole matter to them..I think they should understand your problems . It's just for the safety of your HCL the same is very much common in India. It's a country where DG CBI address to the media ...Quote Unquote " IF YOU CAN NOT STOP RAPE, JUST ENJOY IT ".......It happens in our country only.. In the same manner......QUOTE UNQUOTE ...." IF YOU CAN NOT HELP YOUR STAFF, JUST SPOIL THEIR CAREER BY GIVING NEVATIVE FEEDBACK "........Sorry if I am wrong......

Below matter can be refered for similar cases.
First: HR recruiters have lot of experience handling candidates / new joinees in bulk. Be truthful and precise in your communication.
Second: Relieving letter on the last working day should be fine for time being.
Third: Information to new organization on the current facts in writing i.e. email to official id of the new organization. (about your accident / injury / illness)
Fourth: Delay in joining new organization request should be supported with evidences like medical reports and original doctor\'s certificate.
