Dear Avantika,
you can get Insurance amount from his EPS. If your husband has a member in PF. you surely get Pension and lumpsome amount from PF. If he is having ESIC or anyother Death insurance. you can get back the amount too.
I'm Sure the employer will help you on this.

you are right, but once he get married he have to apply form-2 for change of nominee and if he is not then the case comes under arbitration but employer can give those part to the second nominee.
As Well the member can nominate 2 to 3 members. Hope you know that... Avantika89 you check with your EPF commissioner and they can help you.

Dear Avantika
First you check with the employer whether your husband has incorporated your name as nominee in the Form-2. If it yes definitely you will get the PF lump amount as will as Pension amount. Please do remember at that time approaching to the employer for PF amount and Pension take legal hire certificate Original, death certificate original, Age Proof, Address Proof and Photographs.

Mr.Subba Rao solution is correct. Ask your brother / parents to go in person to your husband employer. Incase if the employer is not helping please approach directly to the local PF authority. And express your grievances to them definitely they tell you the way to get amount. Before approaching to PF authority know your husband's PF account no, what are all the documents you have submitted to the employer.

Dear Avantika,
Sorry to hear about the sad demise of your husband.
You are entitled for following from EPF:
1. EPF accumulation.
2. Pension for you & your child.
3. EDLI: Employee deposit linked insurance.
There are prescribed forms for this, a search of this site will give you details of these & the documents required to be submitted along with the forms. You can get these forms from any EPF office along with an instruction sheet for filling up the forms. But after filling up the forms these have to be routed through your employer. The employer should definitely help you.
You will also get gratuity from the employer.

Dear viewers and respected Ms. Avantika,

Its shocking that HR of company has not been doing HR and we are living in 21st century in Modified era.

Please write below required informations for full understanding of the case:

What is final report, you mentioned in your post, please explain ? What was reason of his death? What is name and address of company ?

You have lost your husband but you have legal claims over legal dues and entitlements such as written here below:

1. Unpaid Salary , leave encashment , gratuity amount , death benevolent fund only if company has scheme.

2. PF accumulation AND interest thereon

3. Pension to you till you are alive and to your child ie d'ter until her marriage.

4. Approx. Rs.75,000/ one time payment from EDLI / Group Term Insurance Scheme.

Benefits under cl.2 and 3 above are admissible in full respect and PF authorities has to settle in a month's time legally.

More on getting few other details asked as above ....................

Best wishes,

Please correct me FEW DOUBTS if wrong:
1) If final report is police report, signed by SUPTD. OF POLICE UNDER WHOSE JURISDICTION DEATH OCCURRED.
2) Was your husband on duty when died or what was he doing that time? His duty time from ---- to---- and date?
3) Company's name and address . Also if easily available then HR manager's name and contact nos.please.
4) Ask your brother, to get Accident report which is filed by company before Factory Inspector. If he died at factory site, then company must have submitted in writing information to Collector, SP, Police station also and copy of letter and accident report can be traced also.
